Fighting a speeding ticket?

Does anyone know about fighting a speeding ticket and how it works with getting rid of points or the ticket all together??

my girlfriend was caught speeding (Ticket says 89 in a posted 60) but she was going faster apparently. the cop said that he reduced it for her and marked the ticket R.
$138 and 2 points.

the problem is that she was driving in an area where she wasn't supposed to be according to her parents and she needs to keep this ticket a 'secret'.

how does the fighting procedure work and what would be best for this not to show up on her dad's insurance?

does she plead guilty with and explanation or does she plead innocent?

what happens if the cop does not show up and what happens if he does show up?

any help would be greatly appreciated.

Here's what happened to me:

My mom told me that if I got in one more accident, or got another ticket that she would take me off of her insurance.
One day I did a rolling stop at a stop sign (only slowed down to about 3km/h) and the cop pulled me over. He gave me a $110 ticket, and I lost 3 points. I didn't want to go fight it because they would be sending me stuff in the mail, so I just went and paid it off. I thought everything was cool, and my mom didn't know until about 2 months later when they sent her a receipt in the mail, and some slip saying that her insurance almost doubled.

I got in twice as much trouble as I would have if I just told her when it happened. She was even more pissed that I didn't go and fight it because I could have at least got the points dropped, and it wouldn't have affected my insurance.

I have never fought a ticket before, but I hear in a lot of cases the cops don't show. If they didn't come, she would at least get the points dropped...and maybe even the whole ticket voided.

As long as she lost points...the ticket WILL show up on her dads insurance, so I guess you got no other choice than to go fight it.

The insurance companies do not care about demerit points.

All they care about is that you were convicted of a moving violation. Points or not makes no difference.

Given that the ticket is already marked as having been reduced from the actual speed measured, and given that if it goes to trial that the original speed measured will be brought into evidence, I doubt you're going to get much if any further consideration for further reduction.

And besides, it won't make any difference anyways as far as the insurance company is concerned.

Now, keep in mind that the dollar amount on the ticket is the set fine for out of court settlement, What has been starting to occur more frequently lately is that a judge will, if such a reduced ticket is challenged, register a conviction for the original higher speed along with what the fine would be for the higher speed.

It doesn't happen often, but it's starting to happen more often than it did before. Call it a reward for wasting the court's time.

take it to court... its the job of the prosecutor to prove u did somethin worng...

if u get convicted of the charge ur insurance company will be notifyed that u were speeding... now it doesnt matter if u were doing 50 over or 1 over all the insurance company cares about is if u were guity or not..

keep in mind taking the plea is still admiting to guilt thus making u guitly and making ur insrance company premiums higher.

the only way to beat the insurance company is getting the ticket dropped... personally my lawyer has never lost any of my tickets.

Well i just typed this out, in another thread....but u could get a break depending on, if this is ur g/fs first ticket, if she'z a student or not, and if she was comming home from work or something

Basically if ur student paying ur way through school. u'll get a break

if ur on ur way home from work, it just shows resposiblity and shows that u work and are contributing to society.

If it's ur first HTA offence.....u bring that up, u've never had a speeding ticket before, blah blah

what are the circumstance what was happening that night.....u can bring up anything. . .

however if this isn't her first offence, and she wasn't working at the time and if she isn't a student........and she comes up with some lame excuse.........she'z gonna get nailed.

I say she comes clean with her dad or w/e....if she wasn't going or comming from work and if she'z not a student and yadadadada....

Your better off telling and being honest in all situations, weather it be to the court or ur father. always stay honest and sincere
