there goes my paint job

april 2005 -- so i drive a 97 integra with a new paint job and some guy in his mid 40's reversed right into me, ruining my paint job and bending in my fender. must suck huh? i stopped as i saw a truck was trying to reverse into a parking spot and he was infront of me unaware of what was happening. all of a sudden i see his reverse lights on -.-'' i swear i honked like a mad man hoping he'd stop. i got everyone else's attention but his. the fact that he reversed into me was already bad enough, he even tried to run. but i kept on honking so he finally pulled over. i tell him to give me his insurance papers to copy it down and he can go. but the guy says he doesn't have it. i had to call a cop over sayin if he doesn't show the insurance paper, he'd get a ticket for not having it while he's driving. first he started crying n **** sayin he has no money and he is living off welfare. i was only asking for $300, half of the price of the paint job. i think it's reasonable because after the accident, the paint started cracking. so after his emotional break down my friend finally made him sign a paper saying he'll pay me back within a year. he says that i caused him to stress and it's making him have medical conditions. isn't driving more of a stress issue?

anyway, it's been a good 7 months and i asked my girlfriend to call him asking to see if he has anything at all so i can pay for tuition. but the man says he doesn't have any money at all and he ain't gunna pay. he says "what you gunna do? bring me to court?" so what should i do? would claiming off his insurance make mine higher? i was thinking to consult my lawyer asking for legal advice. but i still wanna check out what you guys would say.

I think you should of call the cops right there, once he didn't show the papers. You may not get the money but at least there will be some justice out of it.

Sick and twisted...I know.

it was on dundas and bathurst it happen on dundas not in a parking lot. i got him to write in paper that he would pay me back and stuff with him signing it if that helps. thanks alot for all the replies

man that is better then nothing but i can't tell you if it would hold up in court. Then you have to worry about paying a lawyer collecting the money, etc, etc

you have enough evidence to hold up in court IMO. The note, pictures are both good.. sue him for what he owes you plus lawyer fees..

we all live in a level playing field in this country. if he screwed up his life and living on welfare then that's his problem not yours. i'd say take him to small claims court.

I agree take him to small claims you have enough to hold up your end... maybe get his welfare checks taken for a few months, force him to get a JOB!

True. Lawyers know loop holes. What if this guy injured or killed someone...Take him to court. I hate bums like that. drive with no ins. and pay the price. We get screwed paying stupid high rates and high tax so this a-hole can drive around and not pay for a damn thing?? SCREW HIM!!!

completly agree, make sure everything is paid for, take him to court or whatever you have to do, if they guy is on welfare I don't know who he affords to drive, I work and I find it really expensive, he should be taking the bus....

screw that guy.... you shouldn't feel sorry for him... should've settled the issue at that time... take him to small claims...
also... if he's on welfare, there's TTC for him... he shouldn't be driving without insurance... letting him go is like putting someone else life in jeopardy... you did a wrong thing tho your intention was nice....

you could take him to court but if he has no money you dont get any. if you have his plate number go to the MTO and get his address and pay him a visit. if hes not willing to pay then 4 flat tires should do the trick

yup, i'd a called the cops then and there...but now, take him to small claims for the amount he agree'd to pay. he $300, is $300 its not like its $50 and no biggie.

I would start the paper work for small claims firstly, call him and tell him that you are taking him to small claims, write down the time and date that you contacted him and everytime before that, this will help in court. When you call him, very calmly tell him that you are taking him to court but your going to give him the chance to pay you before you start filing the papers. I would say give him two weeks. If he doesnt pay or start to pay, then file the papers, its going to take you at least 6 months to get him into court through small claims and cost you upwards to $300, I know I was going through it. You can claim everything, just have proof of receipts etc... I hope this helps, you can actually go online and download all the forms you need. You also have to personally serve him the papers, either in person or by registered mail. Good luck!

Never fall for people's sob stories.. Call the cops, file a report.. THEN if you decide, get a paper from him saying he'll pay you back.. Atleast then when you go to court you have a report of the accident with the note.

With the amount of time and hassle involved you might as well just forget it.
