What should i do?
To make a long story short, this girl hit my car when
i had it parked it in a parkin lot about 3weeks ago.
She said she will send a mechanic who is her friend to fix up the car at my place since there was only some scratches and paint chips.
Anyways, the mechanic finally came in about 3weeks after the
accident and has done a really bad job on the car.. ( i dont think he did anything at all).
So i am now really pissed and just want to take it to the insurance but since i didnt report the accident yet, is it to late to do so now after 3 weeks? and since mechanic already done something to it?
I still have witnesses, if that helps...

If your car was parked, under Ontario fault determination rules the person hitting your car is 100% at fault. Your insurance rates won't go up if you make a claim in these circumstances. I inform the other person that the damage needs to be made right at a shop of YOUR choice, and that if she objects or refuses to pay, that you'll go through insurance. Then do exactly that.
Your insurance may or may not choose to do anything for you after this long of a delay, but at the very least, make sure her insurance company is aware of the accident she created.
This sort of thing happens way too often. If someone hit me in the parking lot or out on the road, there is no way in hell that I would agree to any under the table settlement, especially if I knew I would not be considered at fault by the insurance company. Most of the time, you'll just get screwed over by the person you're trying to be "nice" to.

Thanks for the reply, but i am worried because i heard so many times that if you have a claim record, even if you are 100% not at fault, your insurance will still go up no matter what. Now i am sick of wasting my time on it so i told her not to bother... damn...

No. For accidents involving another vehicle, your rates go up ONLY if you are deemed wholely or partially at fault. If you were parked when you were hit, fault falls 100% on the other driver.
This link gives the low-down on who is considered at fault in various types of accidents. The rules apply even in parking lots - see the special section on parking lots. This is also Ontario law, by the way.

Well, you may have trouble reporting the accident (you have 72 hours to report it), and the insurance won't do anything w/o an accident report.
As for your insurance rates, they won't go up if they're 100% at fault. This has happened to me 3 times in the last 2 years, and my rates never went up.

hm...maybe i should have just reported but i didnt bother,
besides, last week went to church and when i came out,
i noticed huge scratch on the driver side from rear door to front door... its like wtf... again??? happening too often... this time dont know who did it.. hope whoever did it repents for his sins.... bastard..
