Walked out of the gym, to my car, and found...

...some idiots silver paint all along the corner side of my rear bumper. There are no dents but scuff marks a few inches long. My car is as red as a flippin stop sign and still people have to be blind when backing out.

Im hoping most of it will buff out, but I have to get an estimate on the car tommarow. The good thing is the guy left a note, and I just got off the phone with him. So Im glad we still have people in this world who will take responsibility for their actions. He said if its around a 100$ he wants to pay me cash and avoid going through insurance.

My question is if I reported it to insurance, who takes accountability?? I have a feelin there will be something where I end up paying and my insurance goes up...b/c it was in a parking lot or something like that.

What would you do?

if you report it, your insurance will pay it minus deductible

Its a hit and run claim, under collision, you pay dedutible and you shouldn't be charged with a claim since its not your fault (assuming you have reported it to the police)

Through my research it is my understanding that if I pay the deductible my insurance will still go up (anytime u pay a deductible it counts for a claim). If its not my fault my deductible should be waived.

They have to proceed under collision because they do not have any other info on the party that hit you, and if it proceeds under collision, you have to pay a deductible. But if you have a police report stating it was a hit and run, they cannot charge you with an at fault loss as you were not even in the vehicle at the time of the loss. If you have to many of these claims they may raise your insurance, but legally, they can't raise it. Talk to you broker prior to submitting a claim to see how it may effect your rates, some companies have different rating systems

Ok listen to me....


My car was parked infront of my buddies house and some lady missed the brake pedal backing outta her driveway and hit gas and mashed my door completely. Total damages were 2 thousand dollars. The lady admitted it was her fault and came outside when I came outside in mass frustration. She wanted to go through insurance.

I didn't want to. But then I learnt that since I wasn't inside the car, the car was in park and the lady admitted to hitting my car while I wasn't inside of it and it was in park, I didn't have to pay anything. There was no claim against me, she paid the deductible and everything. Nothing came outta my pocket and no claims against me. There wasn't a scratch on her car though.

So all in all, I got a brand new door, new window everything for free. But I lost my car for a week and a half but I had the choice to get a rental but I declined because my parents were going on vacation that week so I just used their car.

Let me know if you have any more questions

PS: the lady did ALL the work, I did absolutly dick all. All you will have to give her is ur insurance number and company and ****....

depending on how hard your car was hit there could be damage on the other side of the bumper too. only way to find out is to take the cover off and have a look. if it was me i'd settle for more than $100 cash or else go through insurance. the guy basically put down in writing that it was his fault with his note. good luck.

I'm fairly sure that since you came out of the gym? That you'd be in a parking lot? If so, then I believe that it is a 50/50 accident because there is no fault insurance, therefore your insurance will pay half, and his will as well.... So go to a body shop, or even before that, just go to a detail shop to see how will they can get the paint out... you'd be suprised in how much crap you can get out with a little elbow grease... then get the bill and charge the guy for it.

I really don't think it's worth it to go through insurance unless your car needs bodywork...

This 50-50 thing because its in a parking lot is BS ... there is no such rule, plus, if you vehicle us parked and unoccupied, how can he be 50% at fault?

And the definition of No Fault insurance is everyone goes back to their own insurer for coverage, it has nothing to do with the other person's coverage (other than the fact they have to confim they have a valid liability poicy) ....Since he has no clue who hit his car, his policy would pay for it under collision minus his deductible ....
