hey bro, i work for the military and work with cops on a daily basis.....first of all drinking and driving is stupid, hope you learn from this. secondly, the worst thing you can do is try to get the cop for improper protocol because they will screw you with more stuff for blading them like that. best advice.........its a 12hr suspension, ur insurance will go up....take the hit this time and use it as a learning experience. bud, everyone messes up in their life and im certainly no exception but you have to pick your battles wisely. this isnt a good one with the zero tolerance in ontario and all the street racing that is going on.

Maybe they (not me cuz I don't drink and drive) did have a drink or two while in g2 but they didn't go back to ask for directions, while reeking of alchohol, lol. Besides it doesn't matter if he smelled you or saw you driving bad he can breathalize you eigther way.

By the way you dont need to own a car to get your g I rented the driving school car to get mine.

I would still fight the ticket but not on the whole protocal thing. That's pointless. Go to Redline legal services talk to Henry, if anyone can get you off he can. He has gotten my off of all my tickets so far. It will cost you but nowhere near as much as insurance will if you get convicted. At least fighting it you might be able to get off, if you dont fight then you lose. Good luck.

thanks bro, but yea it wasnt my fault for reeking of alcohol, my friend spilld some beer on me unfortately and i bitched at him good cuz i told him if i get pulld over im fukd. plus the only reason i drove them home cuz one of their bf wanted them home so i had to take them home, so much for tryn to be nice ehh, and yea i even stayed back couple hours more just to rid off the alcohol from my system, but guess it needed more time, i guess ur rite wit the technicality thing, probly lookn at more leniency some how, more like a miracle. but yea i know im fukd, but its better trying then not rite? the cop was actually really nice actually, maybe he wont show up? i mean i was upfront wit the guy and everything. he wanted to impound my car for the nite, but i convinced him not to, is there a way to like contact the officer and talk to them? like i heard stories of ppl reaching the cop and tryin to see if they will show up to court and stuff or talk them into not showin up.

thanks for ur input, ill keep a note on that, and i concur don worry, traumatized as hell from drinkn now.

The officer probably assumed that since you were driving, that you had your licence. You had booze spilled on you and thats why you smelled like it? Wouldnt exactly hold up in court. When you only have your G2 licence, the laws are very specific. I wouldnt try to mess with them. Sure you can try to fight it, but I don't think they would be very lenient in such a case.

fight it. sure you ****ed up and learned a lesson, DON'T DRINK AND DRIVE! now take that to court maybe pospone it couple of times hope he won't show up so insurance won't *** u in the ***. no lawyer can help u with this so don't waste ur money, if the cop shows up just plea guilty with an explanation. g/l

r u sure u were fine? u went back to talk to a cop... why would u want to talk to a cop? why didnt u just go to a gas station

u asked to get booked...i have my g2 i might have one or two beers but i make sure i have mints and **** but yeah...u asked for it

but its all good i would fight it either way ur ****ed what else do u have to lose...serioiusly be optimistic

and if u get convicted, the insurance company wont see it on ur record until they pull up a vehicle history report on u and they dont touch it until u change something on ur policy or also depends on ur dirving history including ur parents and brother or juss random

don't do this.
the guy got a DUI, not a 10 over the speed limit ticket...they are VERY different, and to waste his time trying to fight it is just plain dumb imo.

first of all FIGHT THE TICKET

dont listen to these bozos who tell you not to. it is your legal right to fight the ticket and worst case scenerio, if you lose you are in the exact same position that you were in before you tried to fight it. the courts/cop will not add additional charges because you exercised your legal right to challenge the ticket in court. that would be unconstitutional (yes i realize currupt cops threaten this sometimes but it wont happen).

after you register to fight the ticket, you will get a court date in the mail. go back to the court and request a disclosure. this will outline all of the evidence the prosecution has against you and you can decide then if you want to go with a lawyer or not

also check the actual reprocutions from this. it might not affect your insurance in anyway unlike what some of the posters are telling you. i know that if you blow a BAC of .050 to a .079 with a G license, you get a 12 hour suspension, but it does NOT affect your insurance or show up on your driver abstract. so i suspect that even if you do get convicted of your ticket, it will be a non moving violation and wont affect your insurance rates although i may be mistaken on this. call up a broker anonymously and verify..

if it wont affect your rates, dont bother with a lawyer. just go into court and tell the crown that you are a broke student and blah blah and they will offer you a lesser fine in exchange for a guilty plea

Odds are he won't be going in to defend himself. He does have money to lose if it fails, as being represented legally isn't cheap. Sure you may be in the same place where you started but you may also be out a few grand.

There is no question that he broke the law. BTW, going to court and using the "im a broke student bleh blah blah" won't get you anywhere. That doesn't excuse you from the law.

its a $110 ticket. its NOT a DUI

obviously nobody is going to pay $3000 to fight a $110 ticket, use your head. paralegals will charge around $300 to fight it and most will guarentee results... although like i said, there is likely no insurance ramifications so to pay anyone to fight this would be silly.
