Modified headlamps

Angry Modified headlamps

Got $110 ticket for having modified headlamps. My headlamps have a black housing but the turn signal area is chrome with the proper bulb. I also had my day running lamps on and the ******' cop said he couldn't see my lights in the morning.

He was facing east towards direct sunlight. Then he tells me to pop the hood. Says the CAI is illegal, the exhaust, the car is too low, license plate covers are too dark and that the car is for racing purposes.

Didn't have my insurance or my license got tickets for those too, but do I have a case for the headlamps?

Here is what i found for you....
62. (1) When on a highway at any time from one-half hour before sunset to one-half hour after sunrise and at any other time when, due to insufficient light or unfavourable atmospheric conditions, persons and vehicles on the highway are not clearly discernible at a distance of 150 metres or less, every motor vehicle other than a motorcycle shall carry three lighted lamps in a conspicuous position, one on each side of the front of the vehicle which shall display a white or amber light only, and one on the rear of the vehicle which shall display a red light only


(7) No person shall drive upon a highway a motor vehicle where either or both of the lamps that are required on the front of the vehicle by subsections (1), (2) and (3) are coated or covered with a coloured material or lacquer or where either or both of the lamps have been modified by the attachment to the lamps or the motor vehicle of any device that reduces the effective area of the lenses or the intensity of the beam of the lamps.

So what time was the ticket at???

Regardless...

It is unreasonable to expect headlamps to be brighter than the sun!!!

7:50 A.M.

Since I didn't have proper proof of insurance and license do I still have a case?

I would fight the lamps ticket...

Was it certified/smogged with the lights???

Take a picture at 7:50 AM facing the sun and your headlights...

Cop might not show, BS ticket...

Just make sure you are prepared....

Should be fine..

that is bullshit!! actually you are kinda lucky you got away with $290 in tickets.. I've had friends get 5 in one sitting!

headlamps: is the ticket for having clear turn signal bulbs? I tried fighting it in court, they will get you on the line in the HTA that says the light must be 'understandable'. I wouldn't reccomend arguing, just say that you did not intend to put others at risk and have since changed them back to normal.

CAI: bullshit, unless you had a breather or some other way for gases to escape.

exhaust: you did not intend to discomfort others and point out the fact that louder noises come from trucks and busses.

license covers: tell them you purchased the covers at the ministry of transportation. you did not intend to deliberately hide them from law enforcement, or the 407 and have since replaced them with clear ones.

when you get to court, be cool (dont get upset or lose your temper), act innocent and try to tell the cop that you've changed everything back and would appreciate it if he could do something for you. if you can't find him or cant corner him, when its your turn to come up the prosecutor may ask you if you would like to plea bargain or something.. basically plead guilty to one or two of the charges and they will drop the rest. if they offer you this opportunity, TAKE IT!!!!

I made the mistake once of refusing the offer and plead not guilty to the 2 tickets I was fighting.. sure they reduced the charges on both to $30 each ($down from 110) but they both are on my record now so insurance is going to f** me up. its better to have 1 offence rather than 2.
