Ticket for having a breather...

i just got pulled over today and got a ticket for having a breather in my engine. I honostly didn't know they were illegal cause i had passed my emissions test with it on. Well i'm going to fight and explain them this legit reason and hope for the best.

Anyone can help me out?

Passing emissions doesn't make it ok... it's illegal cuz it adds needless pollution to the atmosphere. How much is the ticket? If it isn't that much just pay it, get rid of the breather and re-install that hose.

Your luky you didn't get a BIG FINE..........that is tampering with emision control devices! But none of of us do that, right guy's?

i was simply driving home for lunch from school and a cop just passess me and then U turns, he first noticed that my car was low and asked me to turn my wheel left all the way and right, i passed that then he asked to look under the hood and i said okay then he notices the breather, i guess my cold air intake is legal cause he didn't say anything about it.

I was planning on fighting this case because on my ticket it doesn't say anything about having a breather, it only says operating a motor vehichle with emission control equipment not properly maintained. Under the highway traffic act ontario regulation 361/98 sect. 7(1)a
I was going to fight and say i passed my emission test and show them the reciet of it showing that everything is okay and passed.

My ticket was $340

any other suggestions of help?

sounds like u got a case...... specially if he wrote that..on the ticket!!

You can fight it, but if the cop shows up, you don't really have a leg to stand on. Judging by the description of HTA section they wrote on your ticket, you were actually guilty. I would suggest that you replace that breather with the proper hose and let them know you have done this when you go to court, at least you might the fine reduced.

i dont understand why cops insist on doing that!!

it is CLEARLY stated in the HTA that a car is not too low if the tires dont rub when the wheels are STRAIGHT! damn cops!!

Take it to court.

At worst you lose and have to pay the fine.

At best you get off and have $340 for car parts.

Which one do you want???

You probably have a good chance that the cop won't show cuz its a pretty dumb ticket.just like 94EG6HB said

thanks everyone for your responses...

yea, i'm kinda pissed yet i don't really care cause i have the money yet i also would have loved to spend that money on car stuff. But yea, i'm going to fight it cause i have nothing to lose so i'll let u guyz know what happens.

by the way the ticket wasn't $340 it was $380...

Dam cops, they got nothing better to do...

me too

i had a ticket fo ran air breether for 380, and took it too court with proper documentation, and stuff......trust me , u can't win ,just becaue u bought it from honda or wherever doesn't make it legal.....

well ,hte airbreether blocks u r pcv pimpe ,positive crankase ventillation, its takin the fumes from u rengine and filtering it into the atmosphere ,instead of being channeled back into u r intake and being reused..............well i had the charges dropped from 380 to 120 and lukily my parents were with me sooo, they ended up paying the fine..........................got a lecture on how i'm an idiot ,but it was worth it ,

well pleading that u did'n't know is no excuse ,caue ignorance is no excuse, second, u plead that u are a student, and can't afford this major ticket...plead guilty.......at the beginning, they will reduce the fine too 240, and then wen u r on trial, u must make it seem that u are having finacial difficulty ,and tell them that u have removed the product, and take some pictures of u r engine bay...then the judge will reduce hte fine to half, and u walk away paying 120 ,if u follow wut i said,,,i promise u that that's how much u'll be paying......it happened to a few of my buddies and we all did the same.........

You got that ticket because you didn't know how to defend yourself. You have no idea how that breather works, so he took your bluff and slapped that ticket on you.

There isn't a performance advantage to having the breather there in the first place. That nipple where your breather resides actually sucks in air - it regulates atmosphere in your crankcase. Your PCV valve is located on the topside of your intake manifold (for most B and D series motors), and runs down into the charcoal canister.
The breather does not cause any adverse effects on emmissions whatsoever, and doesn't release any harmfull gases into the atmosphere.

Get a hold of the Helms manual, and outline sections of the Emmissions system if you really want to win your case.
