Stop sign ticket..

Hey,

I was on a main street in downtown hamilton actually and there was a street that ran threw a neighborhood which came onto the main street.

Anyways, the STOP sign to desribe it:

It goes onto a 1 way street, and you cant even barely see the road cuz theres a big ****ing x-mas tree (so u gotta creep up after the stop sign)

ANwyay.. my argument is i did stop, theres no way the cop saw me.. he was behind in traffic.. there was a group of on-comming cars, so i basically kinda merged into traffic in an ******* way.. The cop pulled me over and siad.. "I guess this will teach u to cut into traffic..'

COMES BACK WITH A ****ING STOP-ticket..

PLUS He forgot to put his signature on the ****ing ticket??? when i took it to the courts to arrange a court date the guy workn there said 'Oh.. no signature.'' then he came back with it signed?? and came me a date on sept 3rd.... WTF?


Anyone gimme some help!!!!!!!!!

how do you figure i was driving like an *******... because I had plenty of time to merge into traffic even if i had to accelerate a bit faster.

How about the signature part... pigger didnt put his Sig on it.. isn't it VOID?

Take it to court. If the cop was far enough behind you in traffic then there is no way that he could accurately judge whether or not you stopped at the stop sign and from what it sounds like he didn't see that. If you can get him to confirm on the stand in court that he was behind you in traffic then you might be able to convince the judge that he couldn't see what was actually happening. I would also bring up the fact that the cop specifically said that he was treaching you a lesson. It's also possible that the cop won't actually show up to lie on the stand, since if what you were saying is true, he made up an offence to give you a ticket for something that wasn't an actual offence.

As the ticket section regulars have pointed out you got a bs ticket for driving in a way that attracts attention. If the cop had handed you a ticket for "cutting into traffic too fast", then I could maybe understand why they would bother telling you that you deserved it. However, since your story is that you got a ticket for an offence that you didn't commit to "teach you" a lesson, I'm again completely baffled as to how anything posted previously in this thread could be of any value to you.

Thanks Kane... the funny thing is my court date was last month.. I just got back from my europe trip this week..

My mom went to arrange another court date.. the funny thing is.. The cop wasnt even there in the first place!!!!!!!

But yeah , my argument is basically going to be that there is no way he could have seen me, due to the fact that he was behind in traffic, aswell as a huge ****n x-mas tree.. no way he oculdnt seen ****!

Fight it! They cant PROVE ANYTHING.... the judge will never know what REALLY happened so play innocent

when i comes down to his word VS. the cops, the judge will probably take the cops side.

how far back in traffic was he?
might be a good idea to go back there and see if it is actually possible to see you, and maybe take a picture, not sure if that will be allowed in court(never been, im a law abidding citizen ), but might help you in some way, cause if he was able to see you, you most likely won't have a leg to stand on.

did you actually stop at the stop sign? or kinda coasted past the line so you would be able to see traffic?

i had a friend who coasted thru a stop sign while a cop was stopped to the left at another stop sign.

he got one of those x-copper type people and he won cuz there was no way the cop could prove that he coasted thru the stop sign.

some cops write tickets and don't show just to teach you a lesson and create a pain in the **** for ya.

Take it to court and Plead qualty with an explanation, this should lower your fine or even better if the cop does not show up at court plead not qualty and it will be thrown out since there is no witness.. Worked for me.

If you plead guilty with an explanation you lose the points anyway but your fine will be lower. Seeing as a 3-4 point offence like running a stop sign will cause an almost definite increase in your insurance of 40+%, I don't see any merit at all in pleading guilty with an explanation, which will reduce your fine, which is $110 I think. Save 50 bucks now and pay 40% more on insurance for the next 3 years. Hmmm anybody got a calculator?
