Improper muffler
so ye basically i got pulled over for an improper exhaust... he said it was too loud....
now as of right now i don't want to change my exhaust....
just want to know if i go to court what do i say to get off the hook for this ticket.. cuz IMO its BS
how can I justify my loud exhaust or say that its not loud or what?

dan, ur muffler is re-goddamn-diculously loud...ur not gettin off the hook on this one, a letter stating that its not illegal means nothing, plus all the CARB Legal stuff means nothing in Canada as its an american thing...put a big *** resonator in there and shut that exhaust up

Car sound industries hereby confirms that all MagnaFlow performance exhaust system components, when correctly installed and during proper operation of the vehicle will not produce sound levels excess of 87dB at a distance of 1 meter ( as tested on a wide range of vehiclesP) as specified in the Canadian Highway traffic Act. MangaFlow mufflers do not general exhaust emmisons that exceed the Canadian and/or EPA emmission standards for Northa america.
Correct install includes.
1- Catalytic converter should not be romoved or modified in any way
2- Muffler inlet diameter cannot exceed the original equipment diameter more than 1/2"
3- Vehicles must not be driven in excess of posted or legal speed limits
4- a normal (acceptable by HTA) engine RPM range muist be maintained during acceleration and deceleration
The Canadian HTA specifies
75. (1) Every motor vehicle or motor assisted bicycle shall be equipped with a muffler in a good working order and in constant operations to preven excessive or unusual noise and excessive smoke., and not person shall use am uffler cut-out, straight exhaust, gutted muffler, hollywood muggler, by-pass or sumular device upon a motor vehicle or motor assited bicycle.

No, wont work. The Highway Traffic Act (of Ontario not Canada) section you quoted say's "to prevent excessive or unusual noise". The officer only needs to say in court, that he "observed the defendants vehicle emiting a noise that is excessive for a 1991 Honda Civic, and upon closer examination of the vehicle the source of the noise was due to an aftermarket muffler".

yeah, he didn't take a DB reading or anything, so it's very subjective and not quantifiable by any means...
usually these get dropped, you have to get a bunch of questions ready to ask him if it ends up going to trial and he starts testifying.. the letter may help but then you'd have to prove that it's installed properly, take pictures of the underbody of your car maybe... ???

haah i'm tired.... on the back there are two different court places.. so i'm not sure i think its the one on trafalger.. and i said i don't think i'll have a problem with the sizing of the exhaust pipes... hopefully

well do i want to plead guilty with explanation or i'm assuming trial option is what i should take tjen i gotta go to ontario court of justice on trafalger road... not far from me.... sweet

never plead guilty with explanation.
best case, you're found completely guilty and your fine is reduced.
worst case, you pay the ticket in full and get charged in full.
i don't see why anyone would choose this over "not guilty" unless you wish to say you were speeding because you're wife was going into labour and you were in the boonies.. or something to that effect.

Just take your muffler off and put a oem muffler on and take a pic with your car and plates on with your OEM muffler on the car to the court. That should fix the problem. Just tell them the muffler was there when i brought the car. So i changed it now. What crap can they say rite? If u don't change it and u want to keep it like that then i can't help u. Try putting a silencer on.

this weekend i had a cop pull me over for my muffler and my pipe is 2.25". cop said it was to loud.....i told him i had the same problem awhile ago and fixed it and when to court and the charge was dropped....the he told me to rev my car and it was not even close to all those other cars you hear...then he tells me to get out and said he can see down my muffler. he was a nice guy and let me go...but from my car being to loud at first to now i can see down your pipe, i think he was inching to write a ticket but had no ground....i been through this once and it is prefectly legal now....just a waste of time.....but like i said he was a nice guy...not all in my face on a power trip/ and RESPECT.....it just shows you not all cops are a$$ holes..
