got in an accident...

Thumbs down got in an accident...

so as the the title says i got in an accident, what happened was i was making a left turn from highway 7 onto brock road (near 407 pickering area) and was in the middle of the intersection when the light turned yellow and there was a car still going through as it turned red just as he was clearing it, so i started to make my turn when i did not realize there was a gmc savana also going throught only on a solid red, at my point it was to late for me to do nething, and that wen the gm it the front/side end of my car. Being a hatchback it crunched up like a popcan.

so what ended up happening is i got charged with "improper left turn" or something cant remember the name. Butneways my question is. is it worth it for me to fight this ticket. because i was told nomatter what when ur making a left turn your always at fault.

ps. the savana only had a flat tire afterwards...

As far as I know, while the light is green the upcoming traffic has the right of way. Now if you are in a middle of intersection and the light is red, you have the right of way. I would say that go fight it, tell em you waited on the yellow and proceeded and still got hit on red light. Should get cleared away, and the other guy should get charged with running a red.

That's just stupid! If you are waiting in an intersection with a green towards you, the oncoming traffic has the right of way. Now if you are in the middle of the intersection and the light begins to turn, you then have the right of way to clear the intersection for the traffic going the opposing direction when its safe to do so. Fight the ticket!!!!!!

I "think" that when you are making a left turn at an intersection, you are "supposed" to sit at the light and not in the middle of the intersection where you are more likely to get hit if someone goes throught the red or yellow. You proceed to make your turn when the intersection is clear. Even on a red, the oncoming traffic still has the right of way.

If you are in the intersection making a turn, and the light turns amber then red, you have the right of way to clear the intersection. (this is if you entered prior to the light turning amber) All the other idiots who try to make the turn after the light turns yellow are breaking the law.

you need a witness to state that you were clearing the intersection and that he ran the red, but i would try and fight it anyways.

one car is allowed in the intersection at the time when making a left

fight the tickets thats bull ****...was there icy roads? iunno how that woulod play a role but thats wack id fight it

ya i have a witness and there contact number.
i think the only reason the officer gave me the ticket is because im 17 drivin a civic...

and no the roads werent icy

IF the other driver did run a red or yellow, then that driver should be charged accordingly. Did that happen? Regardless of whether that happened or not, that is separate from the OP's driving responsibilities.

If you're making the left, it is your responsibility to wait until you can do so in safety. You can't just turn left in front of a fast-approaching vehicle until it is clear that the approaching vehicle is coming to a stop.
Left turn, across path of approaching vehicle
(5) No driver or operator of a vehicle in an intersection shall turn left across the path of a vehicle approaching from the opposite direction unless he or she has afforded a reasonable opportunity to the driver or operator of the approaching vehicle to avoid a collision. R.S.O. 1990, c. H.8, s. 141 (5).
The colour of the traffic lights for or against you, and whether oncoming traffic should have stopped or not for that light, is irrelevant.

Question though. A Sanannah is a pretty large and tall van that would tower over most cars. How could the OP miss it?
