got into an accident last nite...

i know most of you don't know me... i check the forums from time to time... but anyway, i thought i share a bit about what happened...

i was making a right turn at a stop sign... i stopped to check everything... and made the turn when it was clear... then suddenly a guy came running out from my right... and the next thing i knew i ran over his legs... there were a lot of ppl there that saw they whole thing... since it was downtown (around bloor and church area)

i was so scared... trembling all over... i thought i killed the guy... but the policy placed no charges, since it wasn't my fault (from the statements given by the witnesses)...

now I just need to calm down and drive cautiously... don't think I'll be driving these couple days though...

also, i'll need to find a place to fix the dents on the front right panel of my car... do you guys know where i should get it done? ... i only heard about dent doctor.... any help appreciated... thanks...

Sorry to hear that.

Is the guy OK?

Besides the obvious....

He might try and sue you in civil court.

Dents?

Damn dude, that's my biggest fear...some bum trying to make money off me by pretending I hit him No seriously, maybe he was suicidal or just plain stupid. Don't let that shake your confidence....it wasn't your fault. I hope you're okay.

Some dumbasses need to look where they walk...bicycles and pedestrians DO NOT BELONG ON THE ROAD, AND I WILL NOT SHARE MY ROAD WITH THEM. When was the last time a pedestrian or bicycle paid $75 plate registration (those little stickers), and so much tax on buying a car, and so much tax for gas prices...need I go on. There are all kinds of taxes drivers pay that others don't. So **** PEDESTRIANS; STAY OFF THE STREETS AND I'LL STAY OFF THE SIDEWALK!!

about the dent, i know FUSION knows someone in mississauga where you can get you car fix for dents. you can pm him if you like. hope everything is okay for u

Did you actually run over his legs and break them?
CUz if you did... he can take you to court because you injured him. He can sue you for an amount and your insurance liability coverage will cover as much as you paid for. So.. if you have a million dollar coverage.. you are covered up to 1 million in lawsuits (includes lawyer)... However.. if he sues you for 1.5 million.. that extra 1/2 a million is coming out of your pocket.

So... just hope he doesn't sue you. If he does... immediately report to your insurance company so they can prepare the money in the event you get sued. Most insurance companies need a couple days to prepare up to a million dollars for you.

I totally agree with you. Pedestrians think they always have the right of way.

Actually NoSpleeny, I think the highest damages that the Canadian courts have ever awarded was like $2 million or something for loss of life. For two broken legs, it would be like no more than $150K. I say that because Canadian courts only account for ACTUAL damages, not phsychological. Unless he goes to a shrink and gets therapy, in which case you pay his bill....like around $2K max. But then you can countersue for the phsychological anguish you have suffered from his lack of due dillignece in crossing the street outside of a designated cross walk (but you have to get therapy first before you countersue). So say he's out from work for 3 months, so...what's a bum make these days ....that's all you'd have to pay + lawer fees + court cost + actual hospital bills. Nothing else. So...$1M more than covers you in this case....and no judge would award this given the fact that the witnesses said you practiced due care in operating a motor vehicle. The fact the poh-lice didn't issue a reckless driving citation or some other b/s is a true testament to your innocence. Don't worry about it....

PS: My ex g/f got smoked by a truck once. She was crossing on a green, and the truck was a little late on the brakes. She was ok...and didn't press charges either. Most ppl won't.

If you were in the States though......MAN, watch out!!! They can take you for everything you're worth.

I had a VERY similar incident happen to me a number of years ago in downtown Hamilton. Same type of incident. Fortunately there were many witnesses on the street and they all stated that the woman ran out in front of my car -- turned out she was a street person and had done this a few times previously. She only had a sprained ankle from the incident but it really shook me up.

The police took statements from everyone and let me off with a minor "failure to yield" ticket — despite the fact I was completely stopped and the intersection & pedestrian areas were clear when I pulled out. (The police officer said he had to charge me with something )

It's amazing the kinds of dumb things people will do to make money these days.

You won't have to worry about the million dollars for a while, even if you did get sued and the suit was successfull it's not until after the judgement that you have to pay up, it's not like the day he files the lawsuit you have to payup... and the odds of him getting 1.5 mill are really low, he was in the road so it's his fault technically....just like bbarbulo said! i'd say the odds are in your favour but nothings a sure things these days, with our legal system being the way it is, best of luck!

thanks for all the input guys... thanks for the concerns and considerations... i took a day off today to think things over... and to calm myself.... i was still shaking while thinking about it... hope all this will pass away soon... but thanks again for hearing me out...
