Doing a 60 in a 20

Ypu thats right I said it. I was doing a 60 in a 20. Yes I have taken the ticket to court. I have my court date for the 31st of Aug. The offence happened the previous year on Aug 15th. Is there a loop hole for me that the court date is not adequate because it was more than a year after my offence? I could have sworn someone told me that.

I've heard that apparently it violates your rights in the human rights charter for reasonable time or something. I've heard it was 8 months, but it does not say that in the rights charter. If you find out more, let us know

It's suppose to be a year after the ticket date. And I too would like to know where the hell is there a speed zone at 20 km/h?

yeah thats what I ****ing said... Its somewhere in Toronto around Yorkdale. Oh and I found out that it does violate my rights. I have a fairly good chance at winning this case now, since the court date is a year and 15 days after my offence. I have to be tried in a reasonable amount of time, and it states that it is 8 months.

never heard that... If anything it is a school zone with the school in the general area/same street. And that would be a 40.

I was not around any schools either.

So any tickets over 8 months old, you have a bettet chance of winning??....How?

I have about 4-5 tickets in my wallet that are almost all over a year old now.

But did you send them in to be challenged? You have a certain amount of time to send them in, and I believe it is 15 days or something like that.

If I were you, I would call. Normally you have to go in and make an appointment, I don't think they do it by mail anymore. If they do, they may have sent it out and you may get a notice in the mail saying that they did.

Don't fool around with them, better safe than sorry, cause in the end, it's your record that is on the line, not theirs.

^^ Yup i did that too last week with Kracker(mark) and i had them look into them and i was told there still waiting for a date!

Well i guess when my time comes to go to court im going to ***** at them that i had to wait over a year and i shouldnt have to pay!

The 8-month benchmark is not a hard deadline at all. Several court decisions since Askov have significantly eroded that time limit, and in the GTA region, Charter of Rights 11b applications are routinely denied even in cases involving delays of 12 to 15 months.

You can try, but it's going to take a lot longer than an 8 to 12 month delay before any JP will take an 11b application seriously.

I got my ticket at the end of feburary 2006, and my court date is on may 27.
