careless driving! mistake on ticket! help. =(

hello everyone, i got a ticket today after nicking a parking enforcement car. The cop gave me a careless driving ticket. :cry: Anyways, on the ticket, the officer wrote my address wrong, she forgot to put my apt, unit # even tho it was right beside my address on my license. Is there anyway to get out of this?

im soo mad at myself, i know, my fault. :cry:

any other advice as to how i should fight this would be great.

well if not all the info is on the ticket thats a + to get it thrown out... not sure if just an appartment number could do it ... but who knows take it too court..

take it to court??

first go get a consultation, do a bit of research in the library they have a few case study books where you can find a few examples of such cases.

then you decide if you would want to be represented, or represent yourself.

what do you guys suggest? i really need this to go away so im probably going to get someone to represent me.

so im guessing the apt # missing isnt a big deal?

hey silverSiG

ok i was heading westbound on gerrard driving my girlfriend home from school, so this was around 3:40. Sun was bright and a big suv in front of me. I was driving on the parking lane (gerrard is two lanes) going west when all of a sudden the suv switches lane like a maniac, i looked closely to only see the red and blue lines and i switched lanes right away also but no luck, my passenger side fender nicked the rear corner of the parking enforcment car. hes car had no damage, mine had a dent. he said, he had to call the cops becuase it was a city vehicle and thats the only thing he could do. so then the cops came and so did the parking enforcement supervisor or something. they talked and i had no say, they told me to sit in my car. 45 minutes later, the lady officer came up to me, gave me a report, told me to call insurance(which i havent done yet becuase im soo stressed) and then handed me a ticket. i said "theres a charge" shes like "yes, its obvious that you were either speeding or following to closely becuase you should of been able to stop in time." and i then i was "but.." shes like "dont say anything" and then i just nodded and shes like, "i suggest you take this to court considering your on your g2 license" and then left. i sat in the car looking at the ticket all pissed at myself and all and then i asked the officer if thers any points shes like yes, theres six and left. :cry:

very sad. i hate myself. today was a sunny day too and the wet snow banks didnt help.

the ticket however misssed out my apt number. and do officers have to circle the ON part for province after the drivers license number?

I dunno maybe she "purposely left that info out" she did suggest you take it too court.. so go that route.

but will that information missing be enough for the courts to throw it out?

becuase i really want to hire a paralegal representative just to make sure, but im tight on cash so if i can just go in myself, and note to the crown that my address was missing and it would be dismisssed i rather do that to save myself, lots of moeny which i really need at this time.

yea, im thinking she purposely left that info out too cuz i mean, my unit # was on the same line as my address so i dont know how the cop missed it.

but i cant be too sure about this,

request trial, and get full disclosure, basically its the notes that the officer has to use against you in court.

may take between 1-4 weeks to get it after you requested it.

The information error on your ticket is amendable, there are only two things that are not amendable on the ticket, one is the officer has to sign the notice, and secondly the correct HTA code has to be quoted.

But, if the officer told you to go to court, you should go, even if it is to reduce the charge. The prosecutor always wants to negotiate.

so would it be worth it to hire a ticket fighter?

and does anyone know of a ticket fighter that is really good with careless driving cases?

they won't throw it out, your apt # does not matter
once I had my whole last name misspelled and even
that didn't help. address is really not an important issue
with fighting these tickets (charges). go see a lawyer and
explain you situation, if you say that it happenned the
way you described, you can knock the charge down to a
hefty fine and a lesser conviction. It is still going to cost you for
presentation in court. Do not go to court defending yourself
the judge will laugh in your face and convict you as charged.
You can always hope that the cop does not show up, but
that's a long shot. Try Legal Aid office at East Mall courts,
they have a free 1/2 hour consultation, however I don't
know if they will help you with HTA. I know they do criminal.

In any case if it was a minor accident like you said, I don't see
why anybody should get charged. It's just a ******* scratch.
I think you just got picked on, because the car you hit was
parking enforcement. Accidents happen, that's why they are
called accidents and that's why we dish out $300/month for insurance.

Go see a lawyer, Good luck
