Bending over this Wed.. Advice needed!

Bending over this Wed.. Advice needed!

Here's the long story short (kinda)..


230 AM


- Dropping my girl off in Scarborough, heading EASTBOUND on Sheppard

- Coming up to light @ Brimley & Sheppard, notice a marked cruiser with cherries on issuing a ticket to some guy in WESTBOUND lane... Approaching the light behind a modified Honda and RX-7

- Stopping @ light, officer has already left the other pulled car, approaching the light @ Brimley & Sheppard heading WESTBOUND

- As I start to drive through the light behind the Honda, the passing officer looks over very suspiciously and performs a high-speed screeching U-Turn into the Eastbound lane (light turned green as he was approaching the light pretty fast)..

- At this point I'm shi**ing my pants, and prepare to get out of the way. RX-7 however is right beside me and slows immediately to 40km/h.. Honda does the same, with the officer right behind me. I am now boxed in.

- Cherries are on, I am given a ticket for Following too closely. (3 or 4 points).

- Officer openly admits he had the suspicion I was involved with STREET RACING (!#&#!(*) and that's what made him give me such a harsh ticket.

- Upon taking it up the ***, and leaving the scene EASTBOUND I spot the modified Honda I was following in a parking lot just up ahead.

- I speak to the owner of the Honda, he is very helpful and agrees to come to court with me and testify should I decide to fight the ticket.

So yeah I have this case coming up on Wednesday at night court.

I did NOT commit this offence. I was a good 2 cars at least behind the modified Honda with the RX-7 beside me. To try and make a lane-changing move with the cop on my *** would've been suicide. The perfect case of being at the wrong place/wrong time.

I'd hate to pleady guilty to this explanation. I want to be found innocent, and could not afford legal representation.

Any suggestions? Advice as to what I should expect/do?

Man I was pissed off that night...

Honestly to tell u the truth.........i'd say ur pretty much set, u got all ur facts in order as it appears, very good description.

& The key component a witness, the honda driver. Who will testify for u that u won't following too close.......what more do u need ??? not much more. Just tell it how it is, and i think u'll get off....no doubts.

Walk in there all proper and ready, talk clearly with ur facts, the court room can be intimadating, thus making u talk shaky or sound iffy...........just say it with pride and i'm sure ur set.

Well now it turns out the witness may not be able to make it to the court date..

Would the judge even allow the witness to take the stand without full proof that he/she really was there that night???..

Summon to Witness his *** then.......and get an affidavit signed......doesn't take much...........

mmm where do u live, general region or area?

GTA east is where I'm located...

as for the summoning/affidavit stuff..never been through that process. I'm a newb to these kind of things..

And wouldnt it be too late anyways?

yah ****.......haha the summons to witness is too late.......i just read ur thing...lol wednesday is ur date........mmmmm affidavits can be signed whenever though......hmmmm frig i forget the process, if u can get to a lawyers office or something a commisioner who can sign affidavidts and pay the fee....it'z nto that much.....and if u can get in contact with the CIVIC Driver......ur set......u can admit the affidavit in as evidence.....try and see if the Civic driver can attend on the same day as the trial........if this is ur trial date....or first apperance date. see what u can do...........

the judge will give u some leeway on the process of how u go about saying and presenting ur case.....cause ur representing urself........mmmm but be prepared to get a bit insulted by the judge verbally if u do get the affidavit and the civic drive doesn't show up.......to admit to this signature on the affidavit........


i dunno there are a lot of things that can be done or shouldn't be done....it'z hard to say.........and seeing how ur date is on wednesday it makes it harder.......cause i'm unsure of the proper date restrictions and the times set up to file things.........like the affidavit can be signed and dated....but then it needs to be admitted to the court.......u can pull it out in court and freshly present it..........but the judge will get pissed to ****.........

and in some cases it'z not even worth having an affidavit as long as u can get the guy to show up.............

i say just present ur case as is........verbally just talk at it.....tell him exactly what'z goin down.........and Pay the Civic Driver like $20 to show up or something.......tell him u need him there........tell him u'll pay for his gas or something.......and a coffee or w/e.......and ur fine......
