119 in an 80zone.. oops OPP

Well I finally got my first speed ticket. I was doing 119km/h in a 80 zone. $289 and 4 points ouch.

I am going to be fighting the ticket in the Barrie courts. WOoHoO

I'm hoping to either get it reduced or tossed out. What would my chances be? OPP

It's been about 7yrs since I been to traffic court. What goes on?
Could some one give me a walk through?

I was talking to a few friends, and they said if the cop doesn't show up, the ticket gets tossed. (OPP I dunno ??), and they said something about the radar gun not calibrated the ticket can be tossed out. Do I find this info out before or bring this up in court oout of the blue?

They said I should plea innocent to that charge and guilty to a lesser charge ie. ????? Also they said I could tell the judge "I'm private in the army, I don't a lot of $$ and I have a lot of bills, blah blah blah." With Base Borden a hop, skip, and jump away I'm sure the judge heard this one about a million times before.

I'm not too worried about paying the fine. I just would rather not shell out $$ for that.

Good luck getting your ticket tossed out ... OPP officers usually show up in court. A reduction may be possible, but then again OPP prosecute their own cases (i.e. not a municipal/provincial prosecutor) and are known to be a bit less forgiving. Seek some legal advice before your trial date and for your sake, DO NOT LIE TO THE JP! The last thing you want is to have an obstruciton of justice charge thrown at you for intentionally misleading the court (re: Army excuse). Just my .02

yeah I wasn't going to lie to the judge. Not really worth it to get another charge. Maybe I should check out some legal advice from a traffic lawyer before my trail date instead of going off what my friends say.

I remember with my last ticket back in 96 which was OPP and a careless driving charge. The police officer didn't show up, but had statement or something for the judge. I hired a traffic lawyer for that one. I ended up getting it reduced to an Unsafe move 2 pts, & zero fine. Which was cool with me.
