do u guys know if its legal to have holes in ur muffler

yes it's illegal, exaust gases are escaping..

yes a muffler with any perforations in the exterior casing is a failed muffler, therefore it's not legally acceptable. (perforations either from rust or on purpose)

but i wouldnt be able to pass emisions/safety with holes my my muffler correct?

You cannot have leaks anywhere in your exhaust system, if you do they wont even let you do the emissions test.
