Black Smoke.....

quick question... could my air filter be a cause of this if its really dirty.... not enough air getting in hence what might seem like enough fuel is now too much so it will burn. I notice that its worse the warmer it is out too

possibly, change it anyways.
If you've got a short-ram or cold-air intake i'd highly recommend using a K&N cone air filter. Yes they're more expensive, but they're washable over and over, they won't fall apart (like the cheap filters do) after you wash/oil it.
That reminds me, I should prolly clean mine, I haven't cleaned it since I bought it, when the non-K&N filter broke. One day I was getting gas and checking the oil when I noticed the filter element part was sitting where my a/c condensor used to be. The rubber part was still clamped to the turbo, but it ripped and the filter part fell off.
I had another filter that wasn't a K&N on my short-ram intake and it broke after I cleaned it, so I bought a K&N and washed it over and over, and still continue to as it, along with the SRI is on the wifes car.
