hondata sues blunder (pgmfi.org)

This is of interest to anyone in the Honda community as this type of bickering has the ability to destroy our open-source ecu development and research.

A clear cut case as to why a forum/domain should be owned by a Corporation.

poor dave, he's done so much for the community and this is what happens to him. Sounds like someones trying to get rid of the competition...lol.

Or a clear cut case of why you should actually moderate a forum/domain and its content. Sure a corperation has its own identity but it shouldn't deter anyone from wanting to participate or start up there own forum/domain. He might be a great guy but with all the copyright enfringement lately you should be watching your a$$ for stuff like this just to avoid such situations.
A corperation wouldn't solve the problem. Sure the funding might be there or the blame doesn't go directly to the individual running the domain but if you didn't get into the situation in the first place then you'd be fine. Also many people have stakes in corperations, so an incident like this could impact many lives.
Forums ran by individuals for non profit or little profit intentions seem to be more active and enjoyable for its users.

I would say its 90% what you say. He should have been more aware of what was being posted and what if any laws it didn't follow. From is story though, it seems the incident was dead and taken care of and someone at the hondata corperation decided "wouldn't it be good to get rid of a small chunk of our competition?"

i dont agree with that. if the admins and mods had to monitor every single activity on the board and control what was being posted on the site no one will be on the site let alone chat. matter of fact if that was the case tcc would have been shut down a billion times for all the street racing video's posted, all the negative words said about cops, etc etc.....

wow... yeah if he was a corp he could fold and not be forced to pay...

but just wow... not only does that sound like overkill (although it is the US where they sue for EVERYTHING) it's a damn poorly written lawsuit... I guess anyone can become an attorney in the states? I wonder if he's taken this to a lawyer yet as there are a few things in there that I think a decent lawyer could use to make a case out of it and then reclaim costs from Hondata....

dang. sucks, I've been on that site since like 2002 before they switched to the new format.... so much good work went on over there. hope it works out for him.

does anyone know if he can sell the site, and with the sale the liability arising from the lawsuit? cuz then he could sell it to an offshore corporation, and the lawsuit would just go away.

He already sold the site to a guy in Russia, domain and database...

As the owner during the time of infringement they can name him.

As for KingJames...I guess you are a better man than I. There is no way I would put my *** (and assets) on the line to run this forum or any other.
