being an honest guy and saying your not severely injured is the right thing to do but your car just got smashed up for essentially someone else being careless. I would try to get atleast a bit of compensation from the accident as you could have a fear of driving now or you could have back or neck problems in the future.....u never know

Uhm, did you not look at the pictures on the first page? That rear bumper is completely bent out of shape!! But I guess if you wanna buy it, I doubt that anybody would say no!

i have a buddy club rear bumper and wings west sides.... the back bumper is cracked and needs to be re-fiberglassed...

The way Ontario no-fault insurance laws are written, he would have to be confined to a wheelchair for the rest of his life to get anything like that.

my ability to walk is worth way more than $500,000. Like if someone said, I'll give you $500,000 to bust your legs... I'd tell him to end himself. know what I mean??

I'm going through this thing with insurance right now... they are SUCH ****ING SCAMMERS!!! I'm SO pissed right now. It's not like I'm milkin the system, I just want what I had... and they're totally giving me the runaround!! I had a peice of jewlery appraised @ People's ... well NOW he's telling me that doesn't mean anything... HE thinks the fair value is 30% less... well, if YOU think so, why don't YOU go work in jewlery appraisal then!!! UGH!! so mad!!!

You're right, the wheelchair probably is worth more than $500,000. Point is, you have to really have serious loss and injury to get any sort of award like that.

Ontario law permits law suits for pain and suffering only if a person has sustained a "permanent serious disfigurement" or a "permanent serious impairment of an important physical, mental, or psychological function".

Seatbelt bruising or even a sore neck doesn't come anywhere close to meeting that threshold. You have to be pretty much disfigured or disabled or both. Also, for any awards under $100,000, an automatic $30,000 deductible applies.

You can also sue for certain economic losses in excess of what your auto insurance provides compensation for, such as long term wage loss and medical expenses over and above that covered by insurance.

But that's about it. The only thing left is haggling over how much your car was really worth, and the wholesale appraisal books usually rule there. Oh yeah, you can haggle over how long you can keep the rental while your car is being fixed.

For all you would-be gold-diggers out there, if you want to score big you'll probably have to forfeit an arm or a leg in your next accident, or you'll have to move to Florida for that accident. Up here, little comes cheap or easy.

This whole thing is a load of bull****. I still think he should be compensated justly for what happened. Think about how f@cking scary that would have been...another car almost flew through his windshield!

**** like that can change a person, maybe not turn them crazy or anything, but it still may affect his life and how he lives it. You dive your car every day and now he's probably going to be staring in his rear view more than through the windshield.

I'm no judge, but therein60minutes deserves more than the 10 grand or so his car was worth.

motti, I'm really glad that everythign is tight like that up here, so ppl arent' running around trying to hurt themselves in front of your house so they can sue. so that's great!!! but why the **** are we still paying more for insurance than americans I mean, our settlements are obviously less, yet we pay more!!!! makes no sense.

still, I think the cop should ABSOLUTELY get punished for this, and I don't think that'll come about unless there is a lawsuit for his negligence. I think since COPS pass judgement on OUR driving... they should be held to a higher standard on theirs. I think civilians should have the right to hand out tickets to cops... or at least call them in. I see cops flashing their lights just to pass a red light, then they turn right into a Tim Hortons.

He's going to get compensated. His car will be either fixed or he will be givena cash payout. He'll get a rental car to drive while his car is in the shop. He'll get therapy for any soft tissue damage he may have experienced. If he loses time off work, his loss-of-income provisions of his insurance policy will kick in.

To suggest that he should get some massive cash payout for whar really is nothing more than a simple accident is ridiculous. Nobody died. No serious injuries other than the usual seatbelt bruising and probably temporary stiffness here and there. Most just property damage to the cars.

And for this some of you think he should get that free ticket to riches?

If it were that easy, how many people do you think would start actively NOT avoiding accidents looking for the big payoff?

As for "how scary that was" and how it could affect his life, get real. Life is all about getting through one thing or another, many of them scary. A near miss happens on the highway and you get frightened because of it - are you going to sue for that too? Of course not. You're goingt osuck it up, put it down to experience, and move on.
