Ticketed for Intake / Exhaust
Coles notes at the bottom of this post if you dont want to read everything.
Im gonna try my best not to turn this into a rant thread.
This morning, on my way to work, I roll thru a stop sign in my neighbourhood (Thornhill). Not a full complete stop, but i definitly slowed right down. Maybe rolled thru at 3-5 kph. No excuse, I know.
I look in the rear view, sure enough, Cherries.
Officer approaches the car and asks for the usual documentation.
I surrender my license, registration etc, and he returns to his car.
Upon returning to my vehicle, he asks me to Rev my engine to 3000 Rpm. I rev up slowly and right away he tells me my Exhaust is too loud. Then he asks me if I have any mods under the hood. I said yes.
Maybe that was my mistake, cuz he then asks me to pop the hood. Proceeds to point out my intake (Short Ram) does not meet emissions, as the stock Honda airbox is designed to recycle gas fumes back into the engine, and that this particular intake I have does not. I didnt want to question his knowledge of a basic Honda engine, as I didnt want to agravate the situation.
He goes back to his car, and when returning hands me 3 tickets, outlined as followed.
Disobey Stop Sign / Fail Stop = $110
Improper Muffler / Motor Vehicle =$110
Operate Motor Vehicle with emission control equipment not properly installed = $380
Total = $600
Heres my problem
1 The car was purchased from Sisley Honda, certified and E-tested WITH the exhaust on. Wouldnt that make the muffler legal?
Can Sisley Honda sell cars that arent street legal?
2 The Intake violation pertains to The Environmental Protection Act Sec 7 (1) (b), and not the Highway Traffic Act.
Does anyone know if this violation also includes loss of demerit points?
The officer recommended to set a court date, and show up with an invoice from a credible source (ie: Honda of Canada, or CT) saying that all the OEM equipment has been re-installed, and those two charges would be dropped, so I plan on going to Sisley and seeing what they can do.
Just thought Id share this experience with you guys, since most of us have Aftermarket Exhaust and Intake, and this is a big pain in the ***.

Sorry to hear about that man. Hopefully everything will be ok. I guess if you can prove the car will pass emissions with the intake you wont have to pay that ticket. I don't recall reading anything that says intakes are illegal!
As for improper exhaust, I believe anything but stock, is improper exhaust. Alot of people have posted up there ticket details as well.
Hopefully everything will be ok man! Just be happy your car wasn't towed, or you were not hit with a car too low ticket.
EDIT: wrong forum bro, just get a mod to move it to the ticket section.

Oops! sorry about taht.
Im in the process of finding the actual act that forbids the modification of an Intake. Ill post it when I find it.
I guess youre right tho, coulda been worse.

failing to stop on a stop sign.... i think its 3 points im not sure...
but u will definitely get one.... this offense is like runnin through or beatin' a red light...
good luck...try to set a court date on December 24 in the afternoon..95% the cop wont show up.... lol

Im searchin the Environmental Protection act right now, and cant find anything.

Found it.
Basically it states that you may change your intake, as long as it does the same job your stock one is meant to do, which according to the officer, it doesnt.
7. (1) If a motor or motor vehicle is manufactured with a system or device to prevent or lessen the emission of any contaminant, no person shall operate or cause or permit the operation of the motor or motor vehicle if the system or device, or any replacement therefor,
(a) is not maintained or kept in such a state of repair that it is capable of performing the function for which it was intended; or
(b) is not kept installed on, attached to or incorporated in the motor or motor vehicle in such a manner that, when the motor or motor vehicle is operating, the system or device functions in the manner in which it was intended to function. O. Reg. 401/98, s. 1.

I have the same ticket for the stop sign. Fought it myself and was reduced to 2 points (the minimum) and a $30 fine or something. I took it an went on my way. Insurtance never changed, been about 2.5yrs since.
The intake does recycle the gases, so I dunno about that one. I'm sure you can get those dropped fairly easily. They are nonsense tickets. Especially if the exhaust was on the car when you bought it. Good luck.

the intake one is bs... cause the stock air box has nothing to do wiht recycling exhust gases.... unless you have that tube that connects to the intake pipe disconnected.... in which case the cop is right...
But if I were you, I would switch all the so called "problems" the nice officer complained about....take it to court....get them thown out...then go home happy. What you do after that is YOUR business.

Today I went to Sisley, the place where i purchased the vehicle. Spoke with the used car manager, who says he has never seen anything like that before.
Hundreds of cars have rolled out of the lot with aftermarket Exhausts AND Intakes, and all of them are certified and E.passed.

I asked if my car would pass emissions in its current state, and he said yes.
I think im just going to show up to court with a positive E-Test. If Honda of Canada sees my car 100% fit for driving on the street, I dont see why Officer Dingus would have a problem.

A friend once had the same crap happen to her.....she had to get a signed affidavit from the mechanic, stating the car was inspected with all those parts on it, and passed both the safety inspection and also the E-test. Then she took it to a laywer to get notarized. (anywhere from $20-$40 to get this done.) The affidavit has to have the VIN of the car, the mechanics name and also his certificate info.
Other than that, that's all I remember from what she told me.

didnt fully stop at a stop sign and a cop pulls him over
gives a ticket for not fully stopping
and one for the exaust that i put on like a few weeks before that time
so stupid
the exaust ticket was reduced to $75
and the stop sign was done by a lawyer who reduced the fine to $80 or something and no points
its bs man.. i got bitched at b/c of that
i got a silencer since then and was never bothered
b/c the exaust was loud

the exhaust is a very subjective thing....best thing to do is to request for the police to have an independent source with a dB meter test teh exhaust....but even then they can say that its too loud cause the HTA doesnt have a max dB level...the intake is crap though....do pulover's affadavit idea...its your best bet
