Unhappy Seat Belt Ticket question

Hello all i was one of the people that got pulled over and ticketed during that opp seat belt blitz , were they were waiting on highway ramps to nail cars. . My question is this the cop wrote down the wrong year of my car on the ticket after asking me can i use this to my advantage in court, will the ticket be thrown out ? :cry: Thx ps i just found out my license was suspended when he pulled me over guess he didnt check lucky me.

anyway, the YEAR thing on the ticket does not mean ur Vehicle model year, its the sticker date on your plates i believe

The cop can even have them wrong, as in minor typographical errors, and still have the ticket go through. JPs correct tickets on the fly all the time.

The key thing is that your identity is reasonably certain. The only way you might get off is if your name is "Smith" and he gets it totally wrong, as in "Jones". And even then a JP might allow it, wondering why a guy named "Smith" would 1) accept the ticket with the name "Jones" on it from a cop, and 2) file for a court date, and 3) receive mailed notice of court date, and 4) show up to actually attend court. That would be an extremely odd thing for someone named "Smith" to do, all for a ticket addressed to someone called "Jones", unless of course Jones is really Smith despite the typos in the name.

You can get a seatbelt ticket in a car that you aren't driving. It's you getting the ticket, not your car.

Im sure everyone has forgotten to put on there seatbelt now and again. Its not like i was doing 240 down the highway with firearms spaying out the window and news hellacopter following me SEATBELT wow. Any ways i thought eveything on the ticket must be correct remember im inicent untill proven guilty. And for all the haters calling me stupid

You're not "inicent", you said as much. Unless the cop doesn't show up, you'll easily be found guilty in court.

How fast were you going? Maybe 40 km/h? Oh that speed doesn't require a seatbelt. To prove it why don't you run as fast as you can and jump through your open door headfirst into the dashboard. You won't be going 240 with helicoptors chasing you so it won't hurt right? When you are travelling in a car your body is travelling at that speed. If the car comes to a stop and you aren't tied down to it, you will continue at that speed, face first into an airbag, dashboard, steering wheel, or whatever.

For the record, I didn't think you were stupid until you justified your mistake. There are many people who never forget to wear their seatbelt because the first thing they do when they hop into a car is buckle up. I'm one of them because I have a decent understanding of physics and know that an accident at any speed will probably at least mess your face and wrists up if you aren't restrained.

At least not any of us who don't pay insurance. Wait a minute.... don't we all pay insurance to drive? Oh yeah. Also, see above for why he's stupid.

First let me say this opp officer pulling cars over on a blind off ramp is a saftey concern traffic and the highway backs up.I almost rearended they car infront of me, cause he did what most of u safe law abiding citizens would do when they see police, slam on the breaks causing a chain reaction. Seconed my question was simple i dont want to know how much distance you would fall out of a car door if you ran through it what the hell are you on dude. Third i will and can beat this in court cause on a off ramp how many vehicles are there to look at. My vehicle has dark tinted windows hard to see in the side window, plus i took my seat bealt off to get my documents and to get my drivers license from my front pant pocket. Once again haters P.S i never said i forgot to wear my seat belt i said people forget to wear there seat belt now and again if you were my lawyer i would fire you.

1. You were most likely following too close if you almost rearended the car in front of you, it was probably the reason the officer took a good look at you.

2.Simple law of physics. An object in motion remains in motion unless acted upon but an outside force. Noramally the force created by your body mass is evenly distributed along the seatbelt. With no restraint, you body becomes a projectile until it comes into contact with something that has much greater mass. No need for further explanation here.

3. If your side windows are dark:
A)The officer saw you through the front windshield if you were on an offramp anyhow. So it wouldn't really matter.
B)if below 20% visibility, they are illegal. If he couldn't see through them, I'm sure that's reason enough for him to pull you over anyway.

On those notes, you'd have to pull some kind of horseshoe out your A$$ in order to win this incourt, IMO anyhow. Best of luck.

Call me a hater all you want, but I believe everyone is entitled to their own opinion, now stop increasing my insurance rates.

The injury part is only part of the equation, but it by itself is significant enough. Even if you are the only one injured by your stupid failure to buckle up, we through our taxes and collective insurance rates pay for your emergency treatment, your loss of income, and all of the expensive social and rehab costs associated with your crash.

And it's not just about your injuries for failing to buckle up. The belt is supposed to keep you secure and in position in the event of a car crash, keeping you from bouncing around inside the car where you could severely injure other occupants of the car.

It also helps keep you from being ejected from the car.

Collisions can also result in secondary collisions in addition to the first collision. The seatbelt helps improve your chances of maintaining control of your car after the first crash by keeping you secure behind the steering wheel and brakes of your car. This can help you avoid additional secondary collisions involving other cars and people due to your car being out of control because you were bounced into the back seat or ejected out/through the window.

In that sense, your seatbelts are eseential not only for your own protection, but also for the protection of others in the car with you, and for thje protection of other vehicles and pedestrians around you.
