Offence Notice (Ticket)

Hi there, I was trying to find the section where this post would fit, didn't see anything specific. So here I am.

Back in October of 06, I got a ticket for making an improper right turn onto Dundas st. Basically I creeped the car from a dead stop in the centre lane to the right lane...stopped again, signalled the entire time. Creeped the car into the intersection and then made the right turn. Cop went left, then at some point made a u-turn and stopped me.


"Did commit the offence of: Improper Right Turn" contrary to HTA 141 (2)

Now the cop actually had written down 142 (2) scratched it out and wrote 141 (2).


Do I have any leg to stand on here? Any sort of technicality I can get off?

Also, where would it say on the slip if any points were deducted?

My trial date is in Aug. I'm hoping he won't show up.

post up that section/subsection and that will help with your responses as that's what he's saying you violated

Right turn at intersection

141 (2) Where a driver or operator of a vehicle intends to turn to the right into an intersecting highway, he or she shall, where the highway on which he or she is driving has marked lanes for traffic, approach the intersection within the right-hand lane or, where it has no such marked lanes, by keeping immediately to the left of the right curb or edge of the roadway and he or she shall make the right turn by entering the right-hand lane of the intersecting highway where the lane is marked or, where no such lane is marked, by keeping immediately to the left of the right curb or edge of the roadway being entered. R.S.O. 1990, c. H.8, s. 141 (2).

were you fully in the right hand lane before you turned??

seems like its' gonna be your word against his... you did signal but this is about you not being in the right lane according to the cop....

i say go to court and recount your story exactly like you said it here... it's important that you were fully in the right lane and made a full stop before you kept turning...

From your description, it sounds like you were stopped at the stop line in the middle lane for a red light.

Then it sounds like you decided you didn't want to wait for the light, so you did a hard cut into the right lane, and stopped again before actually completely your turn.

In effect, whether or not you stopped again in the right lane before actually completing the turn, you made your right turn from the center lane.

If this is the case, the ticket is a reasonable one.

Marker,

I did stop two times though and signalled. There wasn't much else I could do. I was on Jarvis making a right onto Dundas. The cop then had the nerve after stopping me to tell me my right licence plate light was off. Not sure what the purpose was of telling me that. When I got home I checked it and it was, and has always been functioning at a 100%. I've checked it consistentlly since then and it has always been functioning.

Stopping twice still doesn't change the fact that you made your right turn from the middle lane.

There wasn't anything else you could do? Sure there was... you could have gone straight through as would have appropriate and safe for the lane you were in, and then adjusted your route to get back to where you really wanted to be.

With respect to your license plate light, why woudn't he tell you, and why would you question him as "having nerve" for doing so? He could have said nothing, and then maybe a little later your other side might also have burned out, leaving you with no working license plate lights at all and open for a $120 fine.

i dont understand, if you are in the middle lane and you come to a stop at a red light and decide u actually had to make a right, its safe to change your lane, why cant you change your lane and make a turn?.

That's just the way it is. Some things you just can't do because of the increased risk of collision arising out of the act.

The common sense way would be to adjust your route, as someone else stated earlier in this thread.

Its not against the law as long as you stop in the right lane before making a turn. Its basically gonna come down how he can prove he stopped in the right most lane before making a turn. I have even done this in front of a cop, i was in the middle lane, had to make a right, cop was in the right lane making a right, i signalled and the cop stopped and let me come in front of him so i could make a right. Just talk to X-Coppers, and see what they say, they have always gotten my tickets either thrown out, or reduced to just a fine with no points.

Don't waste your time going to x-copper, they're a rip off. Just take it to court and maybe your fine will be reduced and no points (or at least a less a point off on the ticket). And pray to god your insurance don't go up.
