Exclamation Need help with muffler ticket! [GUILTY AS CHARGED]

I got a ticket because the cop said i had a free-flowing, racing muffler, didn't say it was loud or anything....

Anywayz need some help, anyone know where i can find info on regulations of who can check under the hood? I heard regular cops can not, and that only specialize cops can open your hood....
Anywaz as for an "improper muffler" , probably going to formula honda and see if i can get a quote sheet for a apexi N1, that way it'll prove even honda sells these so called "improper mufflers"......

anywaz, thats the thing, i don't need a DB meter because it wasn't for sound, it was for "free flowing illegal" muffler as the cop put it, just have to prove him wrong, already looked at the HTA, looks like he is referring to my muffler as a straight muffler, whats the definition of straight muffler?

I believe he thinks its a straight pipe with no baffle...

Could be wrong...

Find the CARB exemption number from APEXi

That will help...

I think you should be able to fight it and win. I guess a straight exhaust means just a pipe without the muffler but i'm pretty sure you arent running one of those right?

But bring your emissions test and take a DB reading to court. That will help you convince the judge that your exhaust is in working order and neither creates excessive pollution nor noise.

As well make sure to ask if the cop has a motor vehicle critical inspection certificate...

(Think thats what its called)

This authorizes him to make pollution and emmision checks of your vehicle...

umm...what does this have to do with this post? he got a ticket for straight thru exhaust. cop doesnt need to have an inspection certificate for that.

HE POPPED MY HOOD

What are the requirements of that? I heard that you need to be some kind of specialist, forgot what....... anywaz he popped my hood and grabbed at my intake for a while, if that was not right for him to pop my hood, at least i can hit him with creditbility

Do you mean Motor Vehicle Inspection Mechanic? Cuz this is the only type of thing mentioned in the HTA. These are the guys that work at the motor vehicle inspection stations. Here are the definitions given:


"motor vehicle inspection mechanic" means a person who certifies by means of a safety standards certificate that a motor vehicle complies with the equipment and performance standards prescribed by the regulations; ("mécanicien préposé à l'inspection des véhicules automobiles")

"motor vehicle inspection station" means any premises maintained or operated for the inspection of motor vehicles and the issuance of safety standards certificates or vehicle inspection stickers in respect of the motor vehicles; ("centre d'inspection des véhicules automobiles")



I dont think a cop needs this type of license to open up your hood. All he has to say is that he was looking for NOS or whatever and that's reasonable grounds enough for him to look under your hood. In fact, this is what it says in the HTA:


Examination of vehicle

(2) Every police officer and every officer appointed for the purpose of carrying out the provisions of this Act may require the driver of any motor vehicle or motor assisted bicycle to stop, move the vehicle to a safe location as directed by the police officer or officer and submit the vehicle, together with its equipment and any vehicle drawn by it, to the examinations and tests that the police officer or officer may consider expedient.


Also


Inspection

(4) The police officer or officer appointed for carrying out the provisions of this Act may, at the location where the commercial motor vehicle was first stopped or at the location to which it was directed, inspect the commercial motor vehicle and its trailer for critical defects.

ive had a ticket exactly like that but on a different car, take it to court, make sure u have the receipt for the muffler and tell them that the place u bought it from said its street legal. just make sure its street legal. thats what i did and it worked for me....BTW that improper muffler ticket i got came along with two other tickets in one stop, all three were dismissed.

thanks i'll do that eric, ok so i can't fight on lost of creditbility, i'll just have to go with street legal and base my case on that......

Bring the car to the wednesday meet as 94EG6HB is bringing DB tester and it might help to present the db reading.... to show it isn't that loud.....or maybe it shows it is loud in which case you scrap the test

ah crap , i totally didn't see this thread till today "thursday" crap, my bad..... thanks for the help though, maybe i can hit a next meet, i have a 7thgen so i dunno how u guys feel about those, i heard tocivics don't likey the new civics
