Cops POPPED my hood.

Can they do this? Cause they did and they had no clue what they were talking about...

I got a ticket (summons to court) for unsafe vehicle.

A tow truck showed up, but he couldnt tow it. So they called a flatbed, then I beged them not, and they let me drive it home.

They said if Im caught driving my car, it will be towed and Impounded.

He said its too low and I have no wipers.

Is there something wrong here? What I dont understand is that its his "opinion" weather my car is "unsafe".

The funny part is that its probebly more safe then alot of the cars on the road. Hell, my probe practily has no brakes, but its considered safer then my Honda...

Well, Its just a regular day in my life. ****, I could could FILL this forums about the ******* herassment I get from police.

My cars not fun anymore.

Hrm...

Too low...? That's bs. According to the HTA.. your car can be as low as you want to have it... BUT when you stop your car at a traffic light and your car is TOUCHING the ground... than that's too low.

If it's ONLY your wheels touching the ground... that's fine.. I will look up the HTA section for you.

About the wipers... If your car has not even a single wiper blade.. you might not have a case here.

It happened whites/hwy 2., Pickering. Id like to see it in the hta because the wheels dont rub and the car is not on the ground. I have to get the car re-safetied again.

HTA
" A police officer or officer appointed for carrying out the provisions of this Act must hold a Critical Inspection Certificate issued by the Registrar in order to carry out inspections under section 82.1 of the Act. O. Reg. 512/97, s. 1."

" Your car will be towed if it is deemed critically defective. The HTA regulation pertaining to suspension and impoundment of vehicles states that the officer can only tow your car away for being too low IF AND ONLY IF your car, while in a stopped position with wheels straight, is touching any part of the vehicle (as stated in regulation 512/97). Anything pertaining to suspension and impoundment of vehicles must fall under section 82.1 of the HTA. "

And the wheels dont touch, but the officer is right, cause he "sais so".
What a DICK:fustrated

Yes. LOL
I think Im screwed for the wipers:

"Every motor vehicle other than a motorcycle shall be equipped with,

(a) a device for cleaning rain, snow and other moisture from the windshield so constructed as to be controlled or operated by the driver"

The car is equiped with this, theres just no wiper blades. So I geuss that would be incompleate, or what?

Yep. I knew about the wheels touching ground only I remember reading something like that law a while back.

Good thing we dug it up. However.. wipers you won't have much of a case on sadly. I never noticed your car had no wipers.

so the police must hold a Critical Inspection Certificate before they can pop your hood or do anything to check for Critical Defects, you can tell them they can check your car only if they have that certificate or else tell them they can call a cop that does have one to check.

There is a wiper in the trunk with a wrence, just in case. I dont drive it in the rain though, so I removed the wipers bout a year ago.

By the way, I was driving to whitby today to PAY a ticket, and got pulled over.

It was OPP on a BIKE. He wanted to check insurance/records/licence ETC. No tickets.
He said nothing about the car being unsafe or towing it...

It just goes to show its the "OFFICERS OPINION". ( and their bollistic POWERTRIPS.)

Im starting my own thred and posting when I get pulled over now. Shouldnt take long to hit 3 pages....

good old pickering area cops eh 1sicsol, sounds like you get pulled over if they don't like what you are wearing one day
the wiper ticket you can fight, just take a picture with them on
also from what i understand, only MTO can tow your car and deem it unsafe

I got pulled over downtown last month. Cop said the car was too low and therefore "unsafe". The wheels don't rub, I'm only on 14" steelies. He wanted to tow the car and take it to a shop to raise the car. Shortly after that he said my calm attitude impressed him so much that he'll let me off on a warning.
It pays to be nice to cops even in the worst situations

Oh ya he said that its "Newton's" law? Physics? He explained to me that when you have to brake fairly quickly the weight of the car should only travel to the front. If you lower the car the weight will not travel and force you to tailspin in an emergency situation.?????????????????????????What??????????? ????????
