Bye Bye Civic23 for atleast a few weeks

well on tuesday april 9 at 10:15 i was driving through my school parking lot and a chic backed out into my passenger side front of the car without looking...
the INS company now is saying about 4,000 worth in dammage and the girl is trying to say that i am at fault when she reversed into me... can i be at fault or what :cry:

it depends on the image that the insurance companies get wtf is she says its your fault and you say its yours both of you are basically paying

If she's backing out of a spot and hits you it's gotta be her fault. But were you speeding? And no witnesses around?

I can't comprehend how it could be your fault If she's backing out of a spot, it's her responsibility to make sure nothing/ no one is in the way.

Depends on the OIC of the case (assuming that police were called to the scene) or the insurance adjusters own investigation.

There are times (rare) when NO one will be charged or at fault and your insurance companies will deduct from both of you.

Sorry bub, but all insurance companies and the police have a rule that states accident that happen inside a closed spot where there are parking spots and parking lines, no one is at fault it is a 50 50 fault, whether she back up into you or not its half your fault half hers, i had the smae problem a few yrs back, i hope you dont get screwed like i did, keep us updated i'd liek to know wut happened?

To further expand upon this law, it all depends on if it was public (municiple property) or private property..

Okay the cops have said that it is likely to be her fault but considering that it is private property they can't charge or blame anyone
now she is saying that its my fault!!!
but a cop told me yesterday that i could have been doing 200km/h and its still her fault because she's backing out of the spot without looking.

Person backing up = 100% fault. However, since it happened in a parking lot = 50/50. It sucks, but that's how the insurance company will handle it.

This 50/50 **** will not fly. Your insurance company will fight the insurance company for your 50% - you should not pay anything.

I was hit in a lot by a truck (partially may fault) but on papaer it looked like the trucks fault. My insurance company went after his and got all expenses paid.
