Pot Holes in the City

Ok, at my work, we had a debate over this issue:
A co-worker wrecked his Mazda 3 rims (driver front and rear) over a crator size pot hole last week on the 401.
The damage: $600 to replaced the OEMs.
Q: City be held responsible or out of his pocket?

you can file a lawsuit against the city...but the waiting will be long

i broke my hub bearing on my old car because of some mammoth size pot hole on morningside and kingston before!!! sucks!

if it can be proved that the city knew about it 24 hours or a week ago or something.

look into it. have your friend notify the city. then drive over the pot hole and claim damages.

city will not pay out.....that happened to me with one of those "squares" that they cut out of the road.

anyway, a few months passed after i filed the claim and then it "expired" according to the city....i had to pay to fix two dents in my rims.

The City will pay if you provide proof (i.e Pictures of said pot hole, damage repair estimates etc.). This happened to me last summer on Steeles Ave. just before young street. The pot hole ripped the oil pan basically in half and seized my zc almost instantly. BTW this was in my lowered 89 CRX. I filed in June and after badgering the City for months on end they settle at 75% of my claim in January. My original claim was for close to $3000 and they settle for just around $2000. The damage didn't cost me near that to fix it as my step dad owns his own auto garage. I also live in Barrie so the tow home would have been huge if I hadn't had access to a truck and trailer.

Just keep fighting the city and you'll get somewhere.

for 600$ worth of damage, it might not be worth it to wait all that time...

Hey Brad, did they overlooked your car as being modified (i.e., lowered). I'd think you might have a hard time getting anything out of them with a modified car. They never mentioned that because your car was lowered that your oil pan was damaged? I'm very surprised!
The co-worker's car is not lowered or any modification done on it, so I don't think he'll have a tough time getting some sort of settlement. Then again, we're talking about the mentioned wait time for a settlement...if it comes at all. I will pass this along. Thanks guys!

u have to take pictures and be sure to take a measruing tape to show how deap the pot hole was, and take pictures of the surrounding areas to show that there wer enot warning signs or anything

but if i was him id fight to get my money..and some..tell him to file for all 4 rims and ask for 1500 so when they lowball him back he still gets what he wanted

I ran over a "pot square hole" last summer, the width of your average single lane traffic. I was talking with my gf in a heated debate and I missed it. Car ran over so hard I lost 2 clip-on wheel weights and I had to spend money to get them rebalanced.

On highway, I try to drive around the holes; locally, I just slow down and go over them at 30km speed or slower.

i have almost missed speed bumps theat where paved colour and not yellow ahd to rape the brakes lol and thats no fun but as far as the city goes i dont think i would personaly wast my time it would take to long and i would worrie more aout some one finding out my car was lowered and stuff blaw blaw blaw

Agreed, but it was right after our afternoon shift and it was 11:30 pm, so the night driving didn't help until you're right on top of it.

It's all good to have proof and all, but we're talking in the middle of the 401 here, so it's impossible to get any kind of measurements or pictures.

Hey XRAY

No the city actually never did ask for pictures of the CRX. I was suprised at this fact also. The rest of my claim was very well documented and even came with a letter from my step dad (shop mechanic) stating the reason the motor blew was due to severe damage to the oil pan.
It's always worth fighting the city for something that wasn't your fault even if the wait is long. It's the principal. Our taxes go up and up and we get crap services.
You do have to hound the city pretty bad and deal with the adjuster they have who deals with these things. I beleave her name is Ellan and she doesn't like to pay money out. Even after they cut my cheque she still waited 3 weeks to mail it to me.

actually there is a difference between city and provincial roads... I'd bet that if you go to the city and say hey I hit a pot hole on the 401 the response you get is so???
