Angry THE WOrst Insurance Experience EVER

Ok last month i was making a U-Turn heading to Zephyers place with MikePasini... Mike was in front of me successfully made the U-Turn and i went to follow.. Now i know what you all are thinking.. yes i signaled yes i checked and the coast was clear and it was NOT illegal to make a U-Turn at that specific location.

As my Car is stopped i hear honking coming from mike.. trying to let me know that this ***** behind me is going to hit me. So i stop look behind me and i hear this girl swear and i watch her rear end my civic. She hit me at less than 25km/perhour witch tells me that any person with a bit of common sense would have jammed on the breaks or swerved. IF SHE DID jam on the breaks her tires would have squealed and she would have been able to stop. ANyhow..

We traded info and we take off.

The next day she calls me telling me it will be 610 dollars for her front bumper so i atold her im not paying for anything its your fault for not paying attention and for not even trying to stop. So she decideds to go through insurance i said fine your choice.

2 Days later i get a call from an adjuster asking me for my side of the story. So i give it to him and explain to him that i could have been stopped for anythign wether it be to make a u-turn or to stop for a kids soccer ball coming accross the street. I also explained that the damage on my car was all on my rear bumper. (see pics.) So he tells me great! ill call you shortly and let you know whats going on.

The next day he calls my house leaving a message saying its 100% your fault and says he will be closing the case.

Im thinking.. UMM WTF kind of investigation was that.
2. How the heck is it my fault.
3. Now what do i do!?!?

Well with good council from mr Team Rukus i called them back the next day saying i want this case reopend and i want a new adjuster representing my case. and i want a proper investigation completed. Now this new adjuster did tell me what the other girl said in her report. She said that

1. My damage was all on my driver side rear quarter panel.
2. I cut across two lanes to make a quick U-Turn

SO basicaly they took her story over mine... after no aparent investigation... im sending them pictures this week... any thoughts on my next steps?

i'd atleast tell them that you do have a witness to this accident...if i'm not mistaken......that does usually help....

So number one, she lied. From the photo, your rear quarter panel looks fine. She could argue that she knows nothing about cars so she might have named the parts wrong however, if she clearly said "rear quarter panel", then she should know the difference between that panel and bumper.

Secondly, if you were stationary, waiting to make an U-turn and she hit you, then I would believe it is her fault. The key word is stationary. But if you "slow down" and trying to make an U-turn all in one shot, that might have not given the other driver enough time to react. Having said that, you could argue that she was following too close.

I was in a similar situation long time ago and the most I got out of it was 50/50. Might you, 50/50 is just as bad as 100%, so you are either 0%, or you get blamed.

Further more, sounds like it is a two lane street with no yellow marked turning zone?

She could be looking down to find a cigarette lighter and lost 2 second concentration, who knows. But one thing I cannot stand is a liar.

Give your side of the story and fight it. Worse come to worse, you get a little insurance increase but that is not the end of the world. Regardless, I would avoid U-turns or any sudden stop for making a turn because you don't want to miss it. There is always a street up ahead and you can turn in and turn out later, making it safe. Even on highway, if I miss an exit, I won't cut 4 lanes to make it.

SO let me get this straight did she hit you while you were stationary ready to make a U-turn? Or did she hit you as you were already turning to make the U-Turn? Either way by the looks of it all your damage is on the rear of the car which would indicate this girl was directly behind you and then struck your car in which case she would atleast be somewhat at fault if not 100%. She probably got tipped off by her agent that if she claims your damage was on your 1/4 panels it would be your fault (In which case it would) I am currently study General Insurance and Auto insurance in Ontario so this stuff is fresh in my head

from what I can see the car was at a left hand turn when her bumper hit the left corner of the bumper...but thats just me

in either case were you in a turning lane and where you signalling such a manuever aka your u-turn and where your brakes depressed so to show the car was stopped and making a turn or were you giving it gas and that would mean the lights are out?

so many things she prolly told her claimsperson that you didnt...

Definitely tell them you have a witness who saw what happened and definitely tell them it didn't happen how the woman says and you have pictures to prove it.

1. I cant use mike as a witness because hes my buddy
2. I WAS stationary at the time of impact
3. I wouldnt have made that stuipd U Turn it Mikey DIDNT lmao.. its ok bud i dont blame you i blame the women driver.

4. THERE WAS a turning lane.. or a dead lane and i was partialy in it because that lane had just begun to form after the island.

Anyways my buds dad is an insurance investigator i hired him to take care of this bull****. The point is there was ABSOLUTELY NO investigation other than some verbal phone convos. So i wont settle for 50/50 at all...

did u goto a reporting centre and use diagrams on the report sheet...I've pwn3d people based on my diagrams even a cop once in court with my diagram...that was golden
