Highway Traffic Act 75(4)

Unnecessary noise

(4) A person having the control or charge of a motor vehicle shall not sound any bell, horn or other signalling device so as to make an unreasonable noise, and a driver of any motor vehicle shall not permit any unreasonable amount of smoke to escape from the motor vehicle, nor shall the driver at any time cause the motor vehicle to make any unnecessary noise, but this subsection does not apply to a motor vehicle of a municipal fire department while proceeding to a fire or answering a fire alarm call. Since it wasn't a Honda you shouldn't get a ticket?

Just suck it up and pay it!

Hey wait a minute....haha where do u work?....i know that area, pretty well!...LOL

was the general rd. wet all around u?...or was it just a puddle?.....
i suppose u didn't have a digital camera on u at the time to take a picture? or anything?

mmm yah...the best u can do...is say u were in a puddle and u were saying by to ur friends...and since it's not ur car...u didn't know the sensitivity of the gas peddle, if this is ur first HTA offence...i'm sure i'll get some kinda break....go to court and u'll for sure get something cut if it's ur first offence....mention that u were comming home from work, and that ur a student, and that just goes to show like prove that ur a hard working student up at 1:52am at night. . .blah blah...just be honest basically....and u should be fine

Absolute liability offence. You either did it or you didn't, and excuses don't make one bit of difference.

And come on, let's be real here. If he doesn't know "the sensitivity of his gas pedal", he shouldn't be driving.

i tend to disagree, i use to drive my moms civic when i had my g1, and when i was going through drivers ed i hop't into my driver instructors civic....thinking it woudl be exactly the same.....his gas pedal was soo sensitive i peeled outta my schools parking lot....and the instructor hit the brake....LOL the jp doesn't have to know it'z ur 20th time driving the car. just say it's ur first and ur car was in the shop.

I've seen a lot of things happen....in front of JP's, that would surprise most ppl, these aren't excuses, these are good points to make and if structured well into a case, it can be used to pursuade. Now if u come out all cocky saying YAH I SHOULDN'T BE CHARGED WITH THIS OFFENCE, I WORK I'M AN HONEST WORKING PERSON, I DO THIS OR THAT of course ur gonna get nailed.....

if something is well structured and organized and flows well and are honest points and u know they are honest points. it shows.

there is a difference between a "chirp" and a full out tire spinning screech...and I think it was a full out screech cuz u were tryin to be cool in grandmas olds in front of your friends...I have chirped it by cops on countless occassions (like accelerating from a stop light and tires chirp on the white road paint) they look and keep goin...but when u mash the gas in a puddle what the hell do u expect to happen in a 3.8l olds? hell a 1.3 suzuki will smoke the tires through a puddle.

And what are u gonna tell the Justice of the peace? that you didnt do it? or that you did do it? cuz even if there was a puddle and u spun the wheels through it u musta stayed on the gas when it hit dry pavement for the tires to screech which would indicate that it was purposely done. Most people when they realize traction is lost dont continue to mash the throttle to make it lose more traction...c'mon dude dont try to pull the wool over our eyes, we were all young and stupid and did crap like this...fess up to it and be a man!

and there are no points for this violation

Now if the JP looked at it like this...and was having a bad day, he'd most likely look at it like this....hahaha not saying ur in a bad mood CyniKal cause u just pointed out something that i overlooked....

and made a heck of a point. . .

Now u better hope and pray the JP isn't having a bad day Aaron or ur payin ...LOL
