ticket i got today

hey i got a speeding ticket today i was givin a 90 in a 50 zone when the officer stopped me he said u were going fast give me ur license and registration so i did came back i asked can i have proof of the speed i was goin at or was i caught on rader he says no but im giving u 90 because i had to go 90 km/h to catch up to u to pull u over so therefore u were goin 90

what bull**** is that so i was half way down the street obviously he has to speed up to catch me wtf im so pissed

what do u guys think

no point on figting that, I had a similar case, I was pulled over by a OPP for doing 130 when I was doing 100 in a zone of 100 and he sayd the same thing when I asked him the exact same question you did, I tried fighting it, but the procecutor sayd he was falowing you, I sayd how he was siting in a spot and then she put it to 115 just so I don't lose points

In court, the cop can say he was pacing you, and caught you doing 90 km/h. (Im sure you weren't going that fast), but if you got points for it, and/or a fine, it doesn't hurt to fight it!

doing 40 over the limit is not something insurance companies like to see......

fight it..... you wont get it thrown out, but try and get it reduced

Get him to say exactly what you paraphrased him as saying in your original post. Then whip out a high school physics textbook and tell him that if he was doing 90 to catch up to you then obviously you were doing less than 90.

I used a similar tactic in court many years ago for a speeding ticket that I received in which the officer also informed me he had paced me. In my case, I was not speeding since I had passed the police car about 2 blocks before he pulled me over as he waiting to pull out of a driveway. Since I had seen the police car I made sure to watch my speed and stuck at the 60 km/h speed limit. After he had written me the ticket I asked to see his radar reading and he advised me that he had paced me. I argued in court that I had seen the officer about 2 blocks before he pulled me over (the officer stated where he had pulled out of to verify this), so logically it would not make sense for me to speed since I knew he would be behind me, and secondly that he had to accelerate quite a bit to catch up with me since there was quite a bit of traffic and he was not able to pull out of the driveway right away after I passed him. In the end, the charges were dropped against me.

I'm pretty sure that the officer has to follow you for a certain length of time for him to get the "approximate" speed you were going.

Now, if you can remember where the officer was (assuming he was at a stand still) and where he pulled you over, you should be able to present this to court that he did not have enough time to catch up to you, pace you and slow down to pullover. I'm sure you can put in a mathematical equation in there too.

Just make sure that before you present this that you establish his initial and final positions. Good luck!
