Oh, and intakes aren't illegaly, as long as they have a CARB (i think thats what its called) or EO number on them.
CARB is American and cops dont care about CARB approved here...intakes are legal as long as u have all the emmission control devices attatched, IAT, Valve cover breather hose etc. any defeation of those devices is a $395 ticket each! I was pulled over and asked to pop my hood, I had a CAI with breather filter (my stoopidness) I got booked for it...the officer was nice about it and explained it all to me and answered all questions I had about modifications etc. he did a quick look over on my car, check for cat. checked the exhaust, rebound on the suspension etc. he gave me the ticket for the breather and told me to fix it and fight it which I did and got it tossed and told me that everything else on the car was fine...great officer (halton region in oakville) only crappy part was that he pulled me over on Speers Rd. when i was mad busy and all of oakville saw this roadside inspection hahaha!

Anyways, I found as long as you don't drive like a dick and draw attention to yourself, you won't get pulled over. Be especially careful at the end of the month - quotas need to get filled, so who better to do it than mouthy rich Civic owners.
Rich? I love my civic man but if i was rich there are 50 other cars i would probably be driving right now.

Just to touch on the noise issue.

In the region of peel they have a 24hr noise by-law.
Meaning at any time of the day and you are being disturbed you can file a complaint with peel cops.

A complaint that won't really do much until after a prescribed or set time...........it just gives the complainy more of a case if needed.......and more of an insentive to cops to quite down the neighbours when the real time comes around "the real noise ban time"

Lotz of things can be argued in court
Lotz of things can or can not be held up in court

i've said it too many times......the law is sketchy.........and u never know how it can bend or shape.......

Great post. I recently got pulled over because of my exhaust. The cop came up and started bitching me out about my muffler, he then then took my documents, left for almost 10 mins, and came back with 3 tickets. 1 - Speeding 2 - Careless Driving 3 - Failure to surrender licence (I don't care about this one).

I was speechless when he handed them to me... I might have been going a little fast, but I was definently NOT driving carelesly.
If anyone was driving like that it was him. I have no proof, neither does he. All I have is a friend in another car who was driving behind me at the time who saw everything.

oh yeah, and he never did give me anything for my exhaust.....

Yep, going to court June or July 2 I have to check...
Prior to this, I've never had any tickets or accidents.
Clean record... I was only pulled over 2 times in my life before this, and not for driving infractions. It's the car... It's like racial (automotive) profiling or something...

can they ticket u for having an engine swap?? .... supercharger, turbo or anything of that sort?? or is that just harrassment material

swaps

swaps aren't illegal but if you dont have papers for your swap to prove its not stolen a cop could give you a hard time and search his records... and you better hope that engine aint stolen or your car is getting impounded.

Turbo's arent illegal, and i believe neither are superchargers.

Just a little extra note here. When reading up on your laws, check all pertinent documents. HTA, EPA and, Transportation Safety Act.
The TSA will give the guidelines for noise (exhaust) limits and The everpopular, Lowered car issue.
Many times, a Cop gets a (traffic) course and thinks that he knows every thing. Generally they will ticket you according to a certain section of the HTA, but fail to realize(or give a s**t) that another publication will actually give the PROPER guidlines.
If you get a ticket, reference the material that you are charged with then, cross reference with other publications. I've seen so many retarded tickets. Getting a ticket for improper exhaust according to tha HTA but clearly the TSA lays out the criteria for exhaust.
Read up on your **** man. Don't be one of those Dorks who complain about supposed bulls**t tickets, then does nothing to educate themselves about the law. I listen to so many friends that bitch about upcoming blitzes then do nothing to make sure that they aren't going to get yanked.
Another reason to know your stuff is that a cop can have your car impounded if they believe that is unsafe for the road. The most often used "reason" is a car that is supposedly too low. Be polite and inform him of the law as you know it, and you better know it.(TSA) If he/she still is going to impound your car, call your lawyer.
As cheesy as it sounds, knowledge is power.

you say we have till 11pm to make as much noise?
wrong i live with a TO cop and the law states, if it excesive noise that is not called for i.e. loud music, loud cars or even, kids playing outside that disderbs other people its illegal. now if you are driving home thats one thing but sitting in your drivway reving your car thats just asking for a problem. look at it this way, not all people have a 9-5 job, so when you are making noise keeping so one up who has to work a night shift, you are infact disterbing the peace.

i got screwed last october / november at hwy 7 and mccowan
i turned from 7 goin south on mcowan , the cop followed me till the 407 and then ... woop woop ... on come the cherries
for 1 it took him a good 5 minutes to come to the car ...
in the mean time i'm waiting ... a second cruizer comes up and parks beside my car ... a third comes up and pulls in front .... at this point i'm thinkin ***** i'm gettin tossed in the can !
both cops take off and finally the one that pulled me over
asks me for my licence and insurance ... no prob this is ready by then ...
he takes a look and asks me if my record is clean and i tell him i have 1 15km over tic
keep in mind i am not pissed or given any attiude ....
he then says pop the hood (i was unaware u can refuse) so i pop't it open i got nothin to hide i'm rawkin a stock 98 D16Y2 (not for long by the way)with an intake .....

well what's he do ? asks me what the blue tube is (intake) and the chrome piece that goes across the engine bay (strut brace)

this point i'm a little annoyed (i'm only like 2 min from home) so i ask how come he pulled me over .... no reply .... goes to the passenger side of my car and asked me to turn my wheel both ways and checks for clearance ....
i'm like is this normal to check ?
he says "no" with attitude
i got neuspeed race springs so the car is pretty low
any way to make a long story short he comes back the following tickets
1. no front plate (o.k. my fault) $110
2. battery tie down loose, battery not secure (news to me) $110
3. bald tires on the front $110
4. super white signal bulbs in the rear $110

i'm like s h i t .... so i try to explain about the tires that i put my winters on and they are out of balance and had to put these crap tires on in the mean time and that i had the winters on stealies in the trunk , which i tried to get out and cracked my door open ...
"stay in the vehicle " and slams my door
i then ask for his name and badge # becuz i feel i'm being treated like some kind of ******* and i haven't done anything

i'm getting tired of typing ....
i went to the justice of the peace the next with the
plate back on my car , the battery securer , amber bulbs for signals , but no time to change the tires
the justice of the peace was cool man , he threw all of them out with explaination except the fron plate cuz he felt there was no excuse for that , but dropped to 50 bux !

in short it is worth fighting tickets

oh yeah the reason i got pulled over was for the super ****e signal bulbs
"you can't have any blue lights on the rear of the car unless u are snow removal vehicle " said the cop
i haven't seen that dick ever since !

I was just curious to know where you got 98 dB's from. As far as I can tell Ontario has nothing in that section of the HTA (75-1) that says anything about decibels (I have the 2003 book Edition of the HTA). I know California, New Hampshire, and a couple of other states have this law, but can't find anything regarding Ontario.

I contacted the president of Vibrant Performance (Mississauga)and in an e-mail he wrote me, he said that Ontario does not have a decibel rating for mufflers.

what proper documents do you need with you when you have mods...? i e swap all i have is the receipt from the place i bought it from with a serial number?? is that ok? why are the breathers illegal??!?

^The paper needs to say the VIN that is on the installed engine so it could be traced to the car it came out of.

-A cop can ask you to pop the hood. You can refuse but he can clain that he has cause to believe that there is an irregularity and you must pop the hood. you can then fight it in court and say that he DID NOT have any cause to search you (sort of like entrapment)

-Keep your voice low and never get angry. fight every ticket. you have the right to a fair trial, if the cop shows up tell the court you are still gathering information and you would like it to be rescheduled to a later date. they will try to tell you they will lower it, refuse and insist that what you did was not illegal. Hope the cop doesnt show of the next time, if he does do the same thing again until the cop doesnt show up. if you know any lawyers that charge big $ and gaurentee the ticket dropped that is what they do.

EDIT: If your engine does not have a VIN IT IS ILLEGAL! even if your engine is from a legit car if there is no vin it is illegal and your car will be impounded

ive had a cop pop my hood and there was a white CRX behind me that was pulled over a couple of minutes before.

the cop didnt nail me for anything but the guy behind me got a $350 for having a breather filter attached to the valve cover. The cop told me he got a ticket for that cause its a "fire hazard". Dont know how true that is.

That fine was an Environmental Protection Act fine for disabling or circumventing the emissions equipment installed on the vehicle.

On most cars, there should be a hose feeding oil vapours from inside the valve cover back into your throttle body or carburator air intake. That creates a sealed crankcase ventilation circuit that keeps oil vapours from leaving your valve covers to escape into the atmosphere and add to air pollution levels.

Remove that hose and add a breather filter, and you make it possible for those pollutants to enter the atmosphere. The "filter" has next to no effect in stopping this.
