Speeding Ticket Question, Please Help!!
 
I just got a speeding ticket...
It was in the country side where speed was 80.
However there was a section at 60.

I saw a OPP going in the opposite direction. After passing it, the OPP U-turned. Then, I immediately slow down to the correct speed.

Then I got pull over and got ticketed...
The officer said I was going at 105 in a 60 zone.
Because I was a student, the officer reduced it to a 90.


Here are my questions:
1) How did the officer clock me when we were going at the opposite direction? Was that even possible?
2) What do I need to do to reduce the payment and points?

Before you try to get off with a cheaper fine in court, you should consider this. The cop will have written down the details of his encounter with you in his notebook, including the actual speed that he clocked you at on radar. The contents of that notebook is considered to be evidence and can be brought up in court. If you decide to go to trial, the cop will testify to that actual speed.

Your actual speed was 105 in a 60, which is 45 over the limit. The Crown can request that the charge be amended to reflect the actual speed , and if you are convicted, the JP can base the penalty on the set fine applicable to that higher speed. That set fine is $7.00 per km over the limit, so you could be on the hook for 4 demerit points, plus $315 fine, plus $75 victim surcharge, plus $5 court costs.

You do the math. As it sits right now, pleading guilty will cost you 4 demerit points, $180 fine plus $5 court costs plus $35 victim surcharge. Do you really want to gamble that piddly fine for what they can do to you instead?

The best you can hope for with a guilty with explanation plea without trial is a reduced fine. However, if the JP sees that the ticket has already been reduced at roadside by the cop, you're unlikely to get much sympathy. You'll just be seen as being greedy.

The other thing is, what are you going to argue with to explain your speeding? That the speed limit dropped from 80 to 60?

If so, then the first thing the JP will ask is, why were you speeding at 25 over in the 80 zone?

My insurance might go up, to up to $800 per year.

lol, for real I was thinking the same. but at the same time, I totally agree the court's time is of value and should be charged for (despite already being part of our taxes etc) just to deter 'tards from taking every little thing to court.

anyways, as a relevant peice of advice, i can only say this... every time I've gone to trial they've made a fool of me. you simply can't win going to trial w/o a lawyer. and a lawyer so isn't worth it, trust me... unless it's a DWI. my lawyer (and the goodwill donations I had to make and the final settlement + associated fines) ended up costing me more than if I had just given up my license for a while.

on the other hand, talking to crown and trying to agree to the same or lower charge but ask them to recommend a lower penalty might work and then ask 180 days to pay. thankfully i learned my lessons and haven't had to make a court appearance since I was like 20-ish.
