Speeding Ticket - Entrapment?
#21
The OP said she didn't see the cop until it appeared behind her with the lights on, just after passing the fairgrounds.
Genius? Careful now. Not visible? Maybe not, or maybe just not easily visible depending on where the cop was parked. Not safe? Maybe, depending on where the cop was doing radar from, or if you're driving without headlights on.
This is where I get to use the word "pylon". Go back to the google street view link I gave and move west along Elgin Mills. Look for the driveway with the pylons on the right. Maybe the cop was sitting right there in the driveway and not on the side of the road? Maybe the next driveway into the fairgrounds instead? The next one after that?
Any of those places would let the cop most easily check the speed of both westbound and eastbound traffic. Either way the cop would be well off the road. It doesn't take any special genius to see that.
If you also read closely, I said IF PEOPLE ARE FAMILAR WITH THE AREA... meaning, I know everyone from the forum does not lives in the same area I do. So Markham Fair Grounds is quite a good land mark for people trying to figure out where I roughly got pulled over. Or if they were trying to paint a mental picture in their head of what happened. Because, yes some people do that. My apologies for not being exact on my location for people devoted on doing google searches.
Like I said, AFTER I passed the fairgrounds I got pulled over… meaning I did not get pulled over at the fairgrounds.
REPEAT, just in case it was missed, I actually got pulled over after I passed the fairgrounds like stated, I didn’t not just say that because it was fun to type <just to add a little sarcasm >
Since you’re so keen on referencing google. I was going WEST on Elgin Mills, WEST of McCowan, EAST of Kennedy. I believe I was closer to McCowan then Kennedy though. The officer was sitting EAST on Elgin Mills, on the side of the road, not in a driveway.
Oh and FYI, just a comment to you referring to google search, you know, on how you said there are pylons in the pictures shown. Did you know google map does not keep an up to date photo of the area you searched…? Those pylons, you pylon, are long gone
Just to repeat my first original post, since certain individuals read only what they want to see. You can see I was disagreeing with my friend about officers needing to be visible. So, AGAIN, please do not reference officers needing to have their hat on in order to give tickets, I am not a moron.
I am simply looking for other people’s opinions on this matter. I am looking to see if people feel the same towards my friend.
Just looking for a simple forum discussion... Oye... i figured the insurance section would be a little more mature, MY MISTAKE!

At no point in my post did I say I got pulled over at the Fair Grounds, you are ASSUMING.

Your original post said that you had no idea that it was a 60 zone. Your original post made it quite clear that you got pulled over AFTER the fairgrounds. That means that you did pass the 60 km speed limit sign shown in the google street view shortly before being pulled over, right? Roughly speaking, right? So where is the issue?

I gave my opinion on the issue you brought up. I didn't call you stupid for asking. I poked a bit at your friend for think the cop car had to be visible, but it was a pretty light poke. Unless you're taking offence by proxy for your friend that night, I don't understand what all this argument is about.

i missed alot here !! techinical it is a form of entrapment, but for som reason police in ontario can have their lights off while parked at night for saome reason. In the States u could say thats entrapment on something like that.

I wasn't really saying they had to have their lights on, I was just asking if they had to be visable.
But yeah, I don't think cops should have to be visable at all... if you are speeding or doing anything else illegal you should be deemed responsible of your actions. You can't only follow the rules because you see a cop afterall.
Oh well, I still uber hate that cop for being there

I was once pulled over at night by a cop I totally did not see. He was facing the other direction and sitting on the shoulder of the road. I was going around a bend and boom, on go his lights.
It's NOT entrapment. The fault was all mine, I WAS speeding. Had I not been speeding, I would not have been pulled over.
Bottom line don't speed and they will leave you alone! lol. That so hard to get? If you get pulled over, whether you saw the cop or not, there must have been a reason (speeding etc...).
