Here is my two cents on this matter. Its a Benz people....It cost $500 just to say hello to the service technician, never mind fixing a scratch on the rear bumper. Knowing Benz the way I do (my uncled owned one), they will charge in over $1000 to fix that scratch, take the bumber off, repair, repaint the entire bumber, etc....$500 ain't going to cut it. He's pulling your chain.:fustrated

Everyone is saying things here but everyone is forgettin ONE MAJOR POINT.
Was the accident reported to the COLLISION CENTRE???
THis is how it works
both parties have 24 hrs to go ot the collision centre
and report it
so if you reported it and he didnt
THEN YOU AUTOMATICALLY WIN
reason being because you didnt waste time in informing the police and such.
Insurance will take the first person to hand in the police report and go by that (so if you falsify some stuff) they might not know. Now you said you have a witness but was he or she outside or inside your vehicle?
inside means NO NO (you cant use them)
outside means YEEEHHHHH YOU WIN
