Silly me, 20km/h over
 
On the way home from work, in my neighborhood and the cop stopped me. Strange thing was the cruiser was parked along the side of the street so I was driving up behind it, than he stepped out and flagged me over. I didn't see a gun or anything.. has anyone heard of this before? Do they mount radars to catch cars this way?

The ticket was 60km/h in a 40km/h zone. I received a ticket about 4 years ago but that was dismissed by the Judge.

Will this ticket count as my first offence? I'm looking to set a court date.

what does it matter if its your first offence?
are you talking about from an insurance stand point?


yes they can mount radars facing backwards...
just cause you didn't see it doesn't mean it wasn't there.

Did you ask to see it?

Well just mentioning because I have a clean record. In hopes that the judge will dismiss this one like he did my last ticket. Not sure if they ever keep a record of a ticket that was dismissed

And no I didn't ask to see it, I should've I know, but it all happened so fast. I was nice to the cop and admitted to speeding, just want to be on his good side since I'll be taking it to court.

I find it hard to believe that you had your ticket thrown out because it was your first offense. Reduce, highly possible, but thrown out?

But, I'm no expert. If that did happen, you got real lucky! Chances are that won't happen again. You're better off trying to prolong the process than applying for charter 11b.. or hoping the cop doesn't show.

i don't know why you people think that the cop has to be in the court room, they don't, they just need to be signed into the court house. As for the ticket, just pay the ****ing thing, it's 20 km's over, thats nothing, you got caught for speed so deal with it.

your insurance doesn't think its nothing for the next 3 years.

The insurance doesn't care about whether you were doing 50 km/h over or 10 km/h over, a charge is a charge, that's all they care about.

A few years ago when my ticket was dismissed the cop didn't show, I was a student and pleaded guilty and the Judge asked me if I had anything to say, I mentioned i was a student and jobless at the time so he dismissed it. But even if the cop wasn't there, I hear the court could still proceed without the cop present

I might consider speaking to a paralegal soon, I know I've been through the whole court issue before, but just thinking about it bugs me. Any recommendations or experiences w/ good lawyers? I know the whole, We Win of it's free.. but do lawyers define what a win actually is? I'd like the charge to be dropped so insurance isn't affected.

The guys at redline are really good apprently. They are too far for me.. they want an extra 100$ each court trial for me since they have to commute far for me. But if you are in the GTA.. i'd use them for sure. They dont settle for no stupid plea bargin.. they actually try to get your ticket dropped by working the system.

Educate yourselves before talking outta ur asses.......whether your speeding 1km/hr over or 48km/hr over the posted limit this is seen by insurance companies as a minor offense and there is no difference between the two!

Thought about it, I'll go see a paralegel first to see what they can do for me.. all I want is the ticket to be dismissed, the only way my insurance won't go up. If they can't do it for me I'll go to court myself.

actually 50 over is a major offense according to most if not all insurance companies

you are an idiot dont post complete bull****, any ticket under 49 is a minor offence an is all counted the same. if you go 49 over that is a major which is 1 major=3 minor. I say fight it the worst thing that will happen is they wont reduce it. The thing you should try to fight is the points better off having it clean. get the officers notes an see if he radared you or paced you. I won a case by arguing how the officer could hae safely radared me going 110 in a 90 when he was infront of me an i won. good luck if you need help PM me i have ha my fair share of eperience. If he paced you hae a good chance of having it reduced/dropped.

on the court date, any advise for what to say to the prosecutor, or even the officer if present. Can the officer drop the ticket if I ask him to help me out? Or is that up to the prosecutor.

I'm going to go in early to speak to both of them.

you don't talk to the cop.

talk to the prosecutor. I usually plead guilty with an explanation. It'll get reduced for sure.
