You're really supposed to move out of the reserved lane immediately, but realistically speaking, it sometimes it takes a little more than the 6 or 8 car lengths that 40m represents.

If it's obvious that you are trying to get into the other lane by your speed and your turn signals, you'll almost always be given latitude. If it looks like you're an impatient self-centered ***** in a hurry looking to blast around those who are observing the reserved lane law, you'll get picked off right away.

There is no defence if you're still there after half a city block. One could reasonably argue that you shouldn't even pull out from a side street at all unless you can immediately merge into the non-reserved lane.

If you got charged under the bylaw, it's no points and and no insurance hit. You have to decide if the time it will take to go book an appearance, and then show up for the appearance with little chance of acquittal, is worth it the $80.

The cop who nailed you is likely a traffic division cop specifically assigned to traffic duty, given that they were specifically waiting for reserved lane violators. Traffic division cops rarely no-show for traffic violation trials.

ohhh well when going home sometimes to get to parkway I'll exit fromt he dvp at don mills head north ... cross the DVP at spanbridge then go up beside the DVP on a side road and down into the valley on the otehr side and then back up to eglinton where you can only go right ... it's 1 block away from the street you turn on to get to the parts office.. I ussually take the diamond lane along elginton because I'm doing the same thing as you turning right ..... anyways ..... haven't been caught yet ....

seeeeeeeeeeeeeeeeee...so i'm not the only one...it juss makes sense to get into the right lane if u plan on making a right. i know i know...they'll still say that i wuz in it for too long...blah blah blah. but really i wasnt...i wuz in that lane for like 3 secs b4 i got caught. but wutever. i mean c'mon...this is juss ridiculous. its not like i wuz holding up traffic or in that lane the whole time. geeeeeeeeeeeeeeeeeez. i mean...if ure gonna catch ppl...catch them during real rush hour...not 15 mins b4 10am.

the times that your not allowed to drive in that lane are clearly posted..... I used to work a 11 to 8 shift and at 11am do you realize it's still bumper to bumper on the DVP .....

and I was using that shift to avoid rush hour traffic

anyways yes others do it too ... you think if you were the only one in toronto disobeying that law they'd try to catch people?

i knoooooooooow they're clearly posted! sheesh. i juss think its ridiculous cuz i wasnt doing anything wrong. i mean...i could understand if i was in the lane the whole time juss to get ahead and a cop saw me and pulled me over, but this isnt that wasnt the case. and i had just gotten in that lane.

i work 11-7 to avoid traffic too...and cuz i hate waking up early.

and i understand ur point jay, i'm just saying...sheesh...i'm not a moron...i understand y i got pulled over in the eyes of the law and i did say that technically i was guilty. i understand, however, i do not agree. bah...now i'm all riled up.
