Rearended someone with expired license
 
What are the consequences of this?

He had expired license, no insurance or owners slip

The cop let me go without anything I just gave the guy I hit my number. My car is messed up but his car has a few scratches.

why were you driving with an expired license?

did you just not have your insurance slips with you, or do you have no insurance?

was a police report made? just seems weird that the cop would let you go, this should have been properly dealt with at the time of the accident with the cop and he should have been able to explain to you what will happen

anyways, you will file a report with your insurance company. There is a $300 deductible.. regardless of fault.

Your insurance company will probably go after the guy with no insurance, and at that point, you would recieve a refund for the $300 deductible you paid but that can take up to a year or more to get back

WOW did the cop let the other guy go? would seem a little fishy if he let him go as well like he knew the guy!

dont know how much that would have cost they guy but your prob. talking upwards of at lest 1000 you would think and loss of his license oh wait he didnt have one!

Just WOW cant belive cops let some thing like that slide! and then they will pull you over for some thing small and give you the ticket! Cops! hahaha

Fill us in on any updates if he got charged or what not!

oh how bad was your car? get it fixed already?

No he didnt let him go, who knows what happened. He only let me go, saying I dont need to report it if im not going through insurance.

The other car most likely got towed if he was missing all the paperwork. I believe no insurance is Upto $5000 not being able to present an ownership paper is $110, that's if the car is registered, otherwise could be considered theft. And not sure about suspended licence.

Now do you have 2-way insurance, where you are covered when at fault and when not at fault?
From your profile I'm guessing you got an em2? How bad is the damage? Just fix your car out of your pocket and I highly doubt the other guy will even contact you.

Ps. Don't even try to argue saying "he wasn't supposed to be on the road...its really his fault" or anything like that.

why would he fix his car out of pocket? Just go through insurance and absorb the $300 deductible... unless of course the damage is less than $300, obviously you will just have to fix it yourself unfortunately.

He did say his car is messed up im pretty sure its more then $300 of dmg. I would have stayed there and told the police that i would like a report filed.

well i kn ow down here *south of u guys* if that happens u get a rape in fines, car impounded and it takes ALOT to get it back so im thinking in the GTA area, itd probably be worse... unless the cop didnt pay attention to a few things and he had a fake insurance slip(unfortunately their going around all over the place.. people pay a year up front, a month later cancel insurance and keep the insurance slip that says their paid up for a year)
ANYWAY lol im sure hell be busy paying out his ass for fines.

So paying 10Gs over 5 years is better than taking a 2G hit right now? Assuming there are no injuries.

I'm pretty sure I was able to help him already, I told him about the deductible he will have to pay if he does go through insurance :thumb:

anways, in this case...since the guy didnt have any papers, he;s at fault regardless...
but he can decide to counter sue if thats something he wants to take on himself...
but that would only be a case with him and your insurance company...this is why its a good idea for you to file a police report...you should do it...and hopefully u took down the officers badge number...so that you have proof the COP told u not to report if youre not going thru wit insurance..cuz from what i know, everything, any collision needs to be reported...but its not necessarty to have a cop present at the accident if in case the damnage is less than 1000$, or if its a parking lot accident thats not fatal. hope this helps
