Quick Speeding Ticket Question
Hey guys, I was wondering if anyone could help me out
I got a speeding ticket today, I was doing 80km in a 50km zone, but the officer dropped it down to 65 in a 50.
However, I was looking over the ticket and I noticed that there was a box titled "Motor Vehicle Involved" and a yes or no box to check off. And for some reason, the cop checked off the "no" box.
Now i have a couple other speeding tickets, and they both have that box checked off as "yes". And i know that if there is an important error on the ticket, it is supposed to get thrown out.
I was just wondering if anyone knows whether or not this will guarantee that my ticket will get thrown out????

I have mixed feelings about a ticket like this.
You broke the "law", you got caught, he gave you a break, it's ONLY $57.00 PAY IT.
The city sets low speed limits (IN SOME AREAS) and then puts speed traps there, fight every ticket.
He gave you a big break, he DID write down your actual speed and if you take it to court, there is a possibility that they will charge you with your ACTUAL speed, and you will more than likely LOSE.
It's only a few hours of work, just pay it and slow down.

no way in hell would it get thrown out over that.... but I would still go to court to fight it bcause the cop may not show up if he does then plead guilty...
the court can not get pissed off, it is without emotion and proceeds with integraty and justice. it is the right of every tax paying citicen to have their case held in court.
also the payment goes beyong the initial cost because of insurance increases. Just be happy you will not be getting any points.

What is true:
-police officer reduced the ticket
-if taken to trial he may get charged with
the original speeding violation which is
more money and demerit points
-insurance doesnt care if you're speeding
15 over or 25 over. A minor conviction
is a minor conviction and will incur pretty
much the same penalty in terms of a rate
hike for the next 3 years.
My advice to you man is regardless of whether you think this cop is cutting you a break. You are entitled to challenge this and the court cost is included in the fine anyway whether you choose to challenge or not. Sure you may get re-charged, and the fine will increase as well as points, but as stated earlier, insurance wise the rate hike will likely be the same and will go on for the next 3 years. At least by challenging it you stand a chance of getting it dropped completely without any hike at all.
If all you're concerned about is points, then just pay it i guess. BUT i cant stress how much points DOES NOT matter in terms of insuarnce rate calculation. They care about how many convictions, and whether they are minor or major. If your at the edge of your demerit points and are bout to get your license suspended, then just pay it.
NOTE: also as someone stated there is no code R on the ticket indicating a reduction, BUT that is something that the JP may agree to ammend and still accept as a reduction.

Look on the ticket.
The charge is simply speeding as per Section 128 of the HTA. That section covers speeing regardless of the actual amount of speeding.
When you go to trial, all the evidence can be introduced. As per Section 34 of the Provincial Offences Act, just about anything on the charging document (ticket) can also be amended based on the available evidence,
The available evidence includes the cop's own verbal testimony, and the cop's notes taken at the time the ticket was issued. Those notes will state the actual speed you were clocked at, as well as any other things that he chose to make note of.
The fine on your ticket is a set fine in exchange for an out of court settlement. If you decide to go to trial, you waive the right to pay that set fine. You also open the door for the prosecutor to introduce evidence as to what you were actually doing at the time.
A JP can make a finding of guilt based on the evidence, including a finding that you are guilty of speeding at more than the amount stated on your ticket, and impose any penalty allowed within the ranges allowed under the HTA. The Ministry then also automaticaly assesses demerit points based on the speed for which the JP convicted you.
More and more JPs are beginning to do this on a regular basis. If your ticket has been reduced, and you still choose to challenge it, you could find yourself looking at a conviction for the actual speed you were caught at.

I always thought that the fine on the ticket is what you will be charged at regardless of the actual fact. I haven't gotten a ticket since 4 1/2 years ago for going 20 over 80 limit, so my bad if I've cause some confussion.
