Pulled over for "Drive without proper headlights"

Hi all,

I got pulled over tonight for driving with "yellow" headlights... yay.

Got charged under HTA 62(1)

Which says:

Lamps required on all motor vehicles except motorcycles

62. (1) When on a highway at any time from one-half hour before sunset to one-half hour after sunrise and at any other time when, due to insufficient light or unfavourable atmospheric conditions, persons and vehicles on the highway are not clearly discernible at a distance of 150 metres or less, every motor vehicle other than a motorcycle shall carry three lighted lamps in a conspicuous position, one on each side of the front of the vehicle which shall display a white or amber light only, and one on the rear of the vehicle which shall display a red light only. R.S.O. 1990, c. H.8, s. 62 (1).

lol fight it...

i got charged under that act for having a crack in the plastic of the reverse light...

when u get a chance go look at an eg;s taillights and look at the reverse section...she gave me a ticket for improper lights...it was as if someone cut out the little rectangle for the reverse light

What time was it, did you need to have lights on?
1 way to fight it:
If your lights were HID and 'appeared' yellow, but agaisnt a piece of paper, ARE IN FACT WHITE... then your lights are white. My 8500k are blue'ish, but white on paper.

However, yellow lights are ghey, and I think that's what the officer is telling you

Amber headlights are legal in Ontario. Talk to the Crown beforehand and you should be able to get the charge dropped.

I thought ur only allowed to have yellow as fogs.

No. The HTA specifically states "one on each side of the front of the vehicle which shall display a white or amber light only". The lights can't be traffic-light orange "amber" though. They have to be the more pale-yellow "amber".

Current Transport Canada federal regs currently stipulate white-only main headlights, but that applies only to new vehicles manufactured for sale in Canada.

Ontario's provincial HTA law gives more latitude, mainly for historical reasons, but the law as written and still in effect is not restrictive to older vehicles that may have once come from the manufacturer with amber headlights or to vehicles imported to Canada from countries where amber headlights were once mandated by law, such as France and former French colonies.

Amber headlights used to be very common in Quebec, and years ago when all cars came with the same standard-sized round sealed beams, Canadian Tire stores here in Ontario also used to sell replacement headlights in both white and amber.

4 year later update lol...

I put it through the system. I still haven't received any court notices.


Thanks all for your support/help (y)

Now rolling with vintage (90s) multi coloured bulbs for daytimes and vintage slight yellow bulbs (Osram) on my newly acquired 8th gen. Might as well blow them out then go LED.
