Parking Lot

ok so anyways the other day i was backing up into a spot at the mall and i felt a bump and some girl was like against the side of front fender of my moms van so i get out and the girl says i hit her :S which i dont think i did i think she hit me.....their is alike a cratch and a few buff marks .....anyways the girl humms and hawwws and says dont worry about it....so like two days later her dad calls me and is like i hear u hit my daughters car she said she layed on the horn for like 10 minutes...i told the guy she said dont worry about it.....he was like its not her car its mine i want you to pay for it its going to be 300 dollars i got an estimate....so im like 300 for that scratch i dont think so if im gunna pay for it ill take it to my buddys shop any ways.....because its in a parkinglot isnt it no fault for the insurance...like is their any way i can get this guy to leave me alone...his daugher supposebly knows some of my friends..and i mean the girl said dont worry about it on the spot and i dont think cops can really do anything about it.....can they? like can i get out of this?

As I understand it, they can't do anything about it. It's been too long since the time of the accedent. Plus, whether it's his car or not, he was not with the car at the time of the accident. She said don't worry about it and that is a verbal agreement. Also, was there paint transfer? Meaning, is there any of their paint on your car to prove that it was your car that made the scratch?

their wasnt even a scratch on my van no paint no damage at all.....and i thought that cause its a parking lot its no fault.....i mean i swear she hit me like its impossible for me to hit someone with the front of my van with me backing into a spot like come on.....i was just gunna tell the guy i talked to the cops and my insurance company and they said to file a claim cause its no fault and his deductible will probbly be more then the damage....

No, because it's a parking lot does not mean it's no fault. Parking lots are private property, which means that the rules of the road do not apply. If you hit somebody elses car, you still hit their car and are responsible for the damage you do. Fact is though, she said don't worry about it which is a verbal agreement and legally binding. You were going backwards therefor it was impossible for you to actually hit somebody with the front. Explain to him politely that since he wasn't there, it's your word agains hers, and that due to the small amount of damage, the only way he is going to get you to pay is if he takes you to small claims court, in which case all the evidence is on yourside anyways. It wasn't reported to the police at the time of accident, so there is no way of proving that the accident even happened. No need to lie to him about insurence or the police. Just explain to him that he might want to reconsider lending his car to his daughter if she is not going to pay attention or fess up to her mistakes.

parking lots and private proprety are always no fault. I had a dude reverse into my car at a gas station get out claim it was my fault. car was with parking brake on and not running. anyways he sratched his bumper on my license plate screws. went to a ministry office who told us to call our own insurance companies and they';d sort it out. no damage to my car so I didn't call.

Also small claims would throw the case out sayingt o settle it in the proper manner which is calling insurance companies

yeah thats what i was saying....like how can i hit someone with the front of my vehicle and i was like almost fully in the spot and she was on the wrong side to drive on anyways in the parkinglot.....their were people in her car...and my buddy was in another car and he said she hit me......and her dad said she had the horn layed for a while...but like if she did why didnt she back up their was nothing behind her......and i had my signal on when i was backing up

no, they can't do nothing about this, dont' worry about it, your fine, forget this, say if your in an accident then you guys get out and look at what happend right? then you guys say, "o, let's go to my buddies garage" and you then say, you know what, i dont' really feel like fixing your crap, they can't say nothing about it, nor the cops can do anything about it, because you left the scene, as soon as you leave wherever it happend, it's over....

unless, you guys swaped insurances, which i dont' think you did, so your good, it doesin't matter if she has your phone number, your good

because it happen in a parking lot your insurance will get charged and you will have a record of 50 percent at fault
I suggest you tell them that and if they want you can go through it - other wise tell them you will split the cost and try to pay less but get out of it as soon as possable

once you pay anything it is settled so I suggest you work up a deal and pay with a cheque.

and if they accept the cheque by depositing it into the account you win

but what ever you do dont let insurance find out about it.

yeah if he calls im just gunna say ur daught said dont worry about it we both left the scene of the accident.....you cant call the next day and ask for me to pay for it.....its like those people that say their fine at the accident and then the next day they act liek their back is broken

i got ****ed like that
a guy hit my car while mine car was off- and he hit my wheel and scratched his bumper then he said its ok and left then 2 years later when i try to switch insurance i find out i have a 50/50 on my record- that bastard report it. I WASNT MOVING _ THE CAR WAS OFF_ HOW CAN I BE AT 50% at FAULT- that happen like 5 years ago-

People will come up with all sorts of excuses just to take advantages of the situation.

If you know clearly it wasn't your fault, which I am sure you are, then don't worry about it.

Base on your diagram, was she on your side of the lane or the other side of the lane? Parking lot aisle is 6m wide and 3 meter is her right of way (going WEST in this case, as you were backing towards SOUTH), and the other 3 is the opposite direction. If she made the left turn, and was going on the other side, it is definitely her fault.

Plus, if you were backing up first before she came into that lane, she shouldn't move her car until you came to a complete stop.
