Hi,

I just have a quick question.

I was in a single vehicle accident a few days ago. I didn't get a charge under the HTA at the time. The opp officer said she'll have her report done in 5 days.

My question is could I still my get *** charged with a HTA offense?
How long could she come back and issue a HTA ticket?

Of course I was extremely nice to the officers, etc.

Either way if I do get a ticket I'm going to court and fight it.

I would think that they could issue a ticket for upto 31 days after the incident occurs, because thats how long they give them to file the tickets in the system after they write them.

Swap - if your not sure if you will be charged, call the officer. Otherwise you will have to wait, they have six months to charge you under the HTA. But they have three years to charge under the CAIA.

do not meet with the officer if you can avoid it. As to charge you she has to personally hand you the ticket(can not mail it). I doubt that she will come to your house to charge you.

For me avoiding the OPP officer will be a little hard.

I live and work at CFB Petawawa. Basicly the OPP officer makes a trip to the base Military Police and they will track me down either to my room on base or they'll come to my work place.

I haven't heard anything so far and the officer does have my cell #.
