Need Help Now-------please
 
my friend was in a car accident yesterday, not a big hit though............don't wanna mention how it was happened here now

it seems my friend had no fault, but that driver refused to pay for my friend's lost

then they went to the accident reporting centre and did all the paper work, and my friend reported the accident to his insurance broker, and gave him all the related information like the accident ref. no.

now that guy called my friend today and said that he will pay for all the cost to fix my frined's car, cuz he knows he is in the fault side and don't want to go through the insurance company

btw, he said he haven't reported to his insurance yet, but he did reported to the police at the reporting centre

now my question is....

1. can it be retracted from the insurance broker just like nothing happened? not sure if the insurance broker reported it to their head office yet

2. if it had been reported to the head office, can it be retracted just like nothing happened?

3. will the insurance company still go through their case?

4. will their premium still be affected?

5. how about the ref. from the accident reporting centre, does all the information go to their insurance company automatically?

6. what about if my friend retract the claim if they have all the accident ref.?

please help, need to have a decision by tomorrow morning if my freind decide to accept the offer

if your friend isnt at fault and he has reported it to insurance then let it be, no big deal

but in anycase once its reported to the broker and a claim is made its done...no goin back from there

your friend's premiums etc wont go up since he's not at fault...the other guy shoulda been quicker to make his decesion, now he's phucked

exactly as matt said...but even a not-at-fault stays on the record for some number of years...6 yrs i think and sometimes ins. companies dont like to see too many not-at-faults....just so you know.

in this case...your friend should be fine.

Depends on your definition of "not at fault".

Not being charged is not the same as not being at fault.

As far as insurance fault goes, you can be found fully or partially "at fault" for an accident even if you were not charged, and even if the other person was charged and you were not.
