making a claim
i got into an accident with my 90' civic... no damage done to other guys car, ten dollars done to mine....i had to get the rear upper arm replaced. For some reason my insurance company put trough a claim.... I didn't even give them permission to... Maybe someone here would be able to help me out...... i need to get that claim off my record....cuz thats really the only proof of my accident

there was a police report made....even though the other guy didn't even want to make one... we saw a cop standing by where accident was (a retired cop), and he said all accidents must be reported...well i find out later you only do if damages exceed $1000.. i ran into the other guy a few months later, and he told me he never made a claim....my insurance company said he did, and how insurance works, is his insurance company fixes his damages then sues my insurance company to get back there money.. they found out because my mom called them for advise and to see if id be covered, simply to get advise...they went ahead and made a claim without our permission..and i want the claim off my record....and there was no damages whatesoever done to other guys car, and only ten dollars done to mine..

they found out about accident cause my mom phoned for advice on what to do... i dont feel they had a right to put through a claim if we never wanted to put one through...which is why i want it off my record...my insurance company in Johnson's insurance, i think its in the gta, how does that make a difference, just curious... thats another thing, im primary driver on this car, but its in my parents policy.... would this claim be on my record or theres if i dont get them to take it off.

Johnson's insurance is a broker not your insurance company ....Look on you pink slip for the name of your insurance company - If your mom just called in and asked for advivce, they would not set up a claim .... Where do you live? where did it happen, and who is your insurance company?

it must be unifund then....they told me that johnson baught out unifund... i live in thunder bay, it happened in this city... and they did put through a claim, i just fixed my car this morning, took me 30 minutes to replace that upper arm that cost $10... i have a question though, would the claim be on my record or my parents.. they had no right to put through a claim.

they said they put through a claim, and im almost positive they did...... but is says here............ "258.1 (1) <http://www.elaws.gov.on.ca/DBLaws/Statutes/French/90i08_f.htm> If an automobile insured under a contract is involved in an incident that is required to be reported to the police under the Highway Traffic Act or in respect of which the insured intends to make a claim under the contract, the insured shall give the insurer written notice of the incident, with all available particulars.

If you have $50 damage or $50,000 damage, under the insurance contract you are suppose to let them know .... we both know this is not the case. The $1000 limit is more for police than insurance companies, as the police see it as a waste of time to come out to an accident if the damage done is below $1000 .... If you do or do not want to report a minor claim, its really up to you, but because the police came out to the accident and a report was made, it ties your insurance companies hands as most insurance companies get police reports from certain areas automatically .... If your mother reported you had an accident to your insurance company, even if you didn't want to claim, they would still set up an incident .... i'm not saying its fair but thats just the way they work ... you should call the company and politely tell them you hav no damage nor does the other driver .... this may help you and your rates ...
