Little Help-Accident
 

So i'm driving north on Street A individual is facing north but pulled off to the side infront of a driveway to a little mall.
She creeps forward a bit more as i'm approaching I anticipate her movement and slideover just a bit just to my left which is slightly crossing over the solid yellow line. As i'm just to her side she decides to pull out in front colliding into the side of my entire passenger side.
Now I had gone to my insurance company today, and the guy tells me there could be a chance of it being 50/50 fault wise.

How the bloody hell could it be my fault?
It's not, it's a no brainer. I was driving straight for god sakes.

Help me out.
This has totally ****ed things up for me.

Forgot to mention I went to the Police Station with the driver of the other vehicle and filed a report. Officer even said it was her fault.

any witnesses? if so...hopefully they can help convince it was her fault....good luck

Well update.
Insurance contacted me. Asked me questions about the accident. How it happened and so forth.
They told me they now need to speak to the other party and get information from them. And that it might take roughly a couple of days.

Question. Should I go get estimates for damage to my vehicle? Or should I wait until they contact the party and then go get estimates?

I also don't have any witnesses, the road was clear, no cars no pedestrians.

It makes no difference now seeing as insurance is aware of it. You may as well get the estimate now.

Sounds like the person failed to yield. If the officer says she's at fault, the insurance company must take that as gospel. Get the estimate, insurance will cover it and charge her for the costs.

If Insurance company is going to take care of it, you don't need to do anything. The Adjuster will do the estimate and send the bill to the other party. Unless you wish to send your car to a particular shop.
