Just got pulled over on the 407
Hey guys, I just got pulled over in the fast lane in the 407 going west. I was in the left outer lane, and there was OPP in the lane to my right. I did not see him, and I passed him.
He pulled me over, and said "I saw you beside and I was doing 124km/h, and then you passed me". So I said I was just keeping up with the flow of traffic. So he took my licence, registration, etc. went back the the car and wrote me a ticket.
Now here's the interesting part: He said he reduced me to 115 km/h, and no points. So I asked him if he had a radar gun. He looked down and said no. So I said ok, and I went on my way. I had a friend with me, and he saw everything. Given that he did not have a radar gun, how can he have reduced my speed to 115, when he didn't know how fast I was actually going? Also, he said he was speeding himself.
What do you think? Do I have a worthy case to fight the charge?

He dosent have to have you on radar. Cop cars have calibrated speedo's, its not as exact as radar, but it will hold up in court.
He gave you a break with the reduction to 15 over, but take it to court and see if he dosent show.

Edit: reminds me of a tatic they used to employ in the US. A cop comes down the ramp and does 65 for a bit. Then he speeds up to 75 and some people follow. Go around a corner or crest a hill and bam. Cops on each side of the road and no where to hide. I don't think they do that anymore as its like entrapment, although it's done in a marked car.

Fight it and say that you were going with the flow of traffic... if its your first ticket they may let it go. In all honesty 124 is not that unreasonable and you right by saying it has become a social norm, but social norms are not laws unfortunately.
the $ and #points doesn't really matter.The 50 dollars is nothing compared to what the insurance company might do. This is a perfect opportunity for them to ask for more money. Fight it for sure!

I'd just pay the ticket and hope that your insurance don't find out. But with no points, it's likely they won't raise your premium. Next time you go out for chicken wings, just order half as much as you use to, and do this for 3 or 4 times and then you'll get that money back. Lol. Good luck!
