hit my park car.

this girl reversed on my car.. she said it was a tapped but half of my car moved back. she has no insurance but she gave me her mom insurance...and i ****ing miss one number of her driver license,i got her address, contact number...i think she was under influenza too.. is that good enough?

D.T.P 12-Sep-2009 04:19 AM

Is there any damage to your car? If not forget about it, if so then you can go through cops. Now only question is was the insurance she gave you was it under the same car? Also you said parked, assuming parking lot? Since cops don't do sh!t if you get into an accident in a parking lot.
Or you could just go to few shops, ask them to give you a quote on whatever damage she did and go knock on her door. I bet her mummy won't be happy about all this.

jvel 12-Sep-2009 04:31 AM

my bumper is a little pushed in and i notice my hood is not straight anymore.. going to unibody tomorrow morning she said to get a quote and call her tomorrow.also one of my HID doesn't work anymore..at first i told her give me 50 bucks for my light cos i might need new bulb but she's trying to give 20 bucks. she's like she only have 20 lol..i'm like no no give me your insurance or whoever this car is under insured, i was pissed cos i already parked my car far from everyone

_andross_ 12-Sep-2009 09:49 AM

that's why you never be a nice guy and just call the cops right away. I don't give a **** if they don't have any insurance or whatever...if they hit me **** them I'm calling the cops. Too many people get ****ed over for being too nice

FiveO 12-Sep-2009 09:52 AM

She already tried to low-ball you with the cost of the light bulb. That should be your first clue that this won't go well for you if you carry on as you have been.

Contact your insurance company NOW to make a claim. Givethem the info that you do have and they will take care of all the BS with the other driver.

Don't believe her if she tries to argue that insurance will hold you 50-50 at fault because it was in a parking lot. Ontario insurance law is quite specific. Because your car was parked at the time and not moving, you are legally considered 0% at fault for the collision and your rates should not be affected.

civicEJ1 12-Sep-2009 10:17 AM

was she hot?

jvel 12-Sep-2009 10:31 PM

yea her dad called me and said get a quote and NOT go to my insurance cos both our premium is going to go up. and no she wasn't hot. her dad explain how insurance work blah blah.. my friends said to milk it. it sucks when you take care of your car and some **** face just going to hit it or open there doors without thinking about the next car..

D.T.P 12-Sep-2009 11:20 PM

Get a nice big quote. Don't settle for cheap jobs. If the guy starts saying sh!t explain to him that you want your car to be EXACTLY how it was before the hit, not almost the same. Go to only reputable shops so down the line whatever the shop fixes it doesn't f^ and come back to haunt you.

Her father either hasn't got a clue or he is outright lying to you. Your premium will not go up because you are not considered at fault if your car is hit when parked, even if it happens in a parking lot.

Ontario insurance law for fault determination in a crash is available online at Insurance Act - R.R.O. 1990, Reg. 668

Specifically, look at Sections 16 and 17 for parking lot incidents.

Question for you - he says to get a quote. Don't forget to make sure that quote includes a rental car for the time your car is in the shop.

Better bet, get a quote and go through your own insurance. It would be a "not-at-fault" claim for you so there would be no insurance hit to you. You owe the father and his daughter no favours.

jvel 13-Sep-2009 01:19 AM

i'm going to see rich form unibody tomorrow hopefully he'll tell me what should i do cos i only have her adress and insurance her drivers license i miss one number, also didn't call the cops. my witness is my friends from scarborough and some random guy that said i should get the insurance info. now i'm worried that the dad might rip me off if he thinks it's too much..i don't want to be an ass and go straight to my insurance..what do i tell my insurance? that this car reversed on my car? without no record?

man up.

thats not being an ass...

Trybal 13-Sep-2009 11:19 AM

Since you have witnesses, you're fine. Make sure to take some pics (of the car and parking lot) and draw the layout of the parking lot and where you were parked.

Get your witnesses to sign the layouts and pics. Also write a statment, describing the situation (with date and time of the incident) and get the witnesses to sign that too.

Its good to have to show the insurance company and also for court (if it comes down to that).

2nd that.

They will try to screw you over. Proof of that, you stated that they are trying to cheap out.

FiveO 13-Sep-2009 11:51 AM

This happened on Friday night. Take the car and your witnesses if possible to a collision reporting center TODAY and you will have a report for your insurance company.

slowandfurious 13-Sep-2009 12:15 PM

man its to late to go to the cops, after 24hrs they wont do anything for you. She can deny everything. Should have called the cops right away, and taken as many pictures with your cell phone of her, her car, your car, ect. At least you can prove that everything went down the way it did. In a parking lot it is 50/50 but i'm pretty sure you might be able to fight it cause your car was parked, your insurer would probibly take her to court.

This kind of poor advice is why so many people are so ignorant of their rights in parking lot crashes.

READ Section 16 and 17 of Insurance Act - R.R.O. 1990, Reg. 668 to get the true story. Parking lots are treated much the same as regular roads when it comes to assigning fault.

More poor advice. The crash happened Friday night. You're supposed to report as soon as reasonably possible, and yes, within 24 hours is best. If he goes and reports to a collision reporting center NOW, he's still within 48 hours and that is still a reasonable time frame.

If he goes through his insurance company, there will be no need to take it to court. His insurance company will take care of everything.

i think I'm going to go to my insurance cos the girl's dad came to look at my car he said it's just the alignment and he said that my headlight is after market and after market headlight doesn't fit exactly as the stock. he took pictures and saying my bumper have been taken off before.he tried to give me 400 bucks but i told him I'll get a quotes and I'll give you a call.. he said that i can't even notice it and if it's his car he'll be able to drive it the way it is..

i would really like to see a pic o the damage... If you have a before and after pic we could see the damage better...

I dont know how much you want to charge the guy for something small ... 400 seems reasonable for the amount of damage you are describing ... I seen friends trying to get 1000s for something that is not even 500 bucks and use the money to repaint the whole damn car (not saying thats you) but i just seen it a few times ..... Funny thing is sometime after they get all that they end up in an accident or spending crazy money to fix their cars ( karma is a bi t ch )

post a picture of the damage ...

jvel 13-Sep-2009 10:19 PM

like i said in the beginning i don't want to be a jerk and i also don't want to pay something that i didn't do.let's say i take the 400 bucks and the cost to align my hood and bumper is 400 bucks. how am i going to get to work and get home? i told him i don't care about the paint i just want to be the same as it was before. just piss me off how he would point out my aftermarket light that it might not fit like stock.you can fully put your finger between the bottom of my light and the bumper. can he really put that against me that my lights is after market?
