Help Seat Belt Ticket!!!

ok so i live on a small street and my house is the last one on the street. abt 45 min ago i am coming to school and my girl picked me up. since i live an the end of the street she waiting for me a car length behind the stop sign.
i sit in the car put my bag on the floor where my feet are got up grabbed the belt by this time she is at the stop sign stopped or stopping or almost towards the stop sign and this happenned probably in 10 sec max..
i see a cop driving by while she is at the stop sign and hes staring into the car. the cop passes by and stop's on the side rolls down his window and asks to stop waving his hand. i saw it my gurl didnt i told her to stop but she tought i was jokin around with her like always..
by the way my street does not have a speed limit its a small street the street she was merging into's speed limit is 40
now he comes after her and pulls her over
Phukin cop goes ur not suppose to put the seat belt on when u see me ... i said she was stopped a car length behind the stop sign he is like no u should have put it on b4 or some ****. and if i wanna trial it i can go to court. gives me a ticket the ussual 85 and payable 110 i swear they are so stupid
can they even give a ticket for not wearing a seat belt on a small street. and i was wearing my belt i just sat in the car....
i dont wanna pay for the ticket as im not ****ting money
so im goin to court but what should i do plead guilty with an explanation or trail it ...... thanks for ur help !!!

i say go to court and explain but its an iffy situation...

i got pulled over rihgt infront of my house for not having working break lights.... this was in mid day of course and with my luck they were both out.... ******* doesn't even go for a warning or anything he just tickets me right away.. i was like "officer... there is no way i could know that they were both out unless someone had told me...im right in front of my house.. im not gonna be driving anywhere now im just gonna go to the back and replace the bulbs.. no harm done" the guy was all like.. "yeah well i have to" what an *******.... my court date is actualy next tuesday for that... the cop althouugh he gave me the ticket said that if i went and bought replacement bulbs that exact date i could go to court with the recipt and they'd wave the charges.. kinda weird but there's no harm in me trying.....

same as for you.. no harm in trying.. and plus if you go for a court date you won't have to pay it for a long while if you end up having to..

so should i plead guilty with an explanation or trial against the stupid cop ... i swear the belt was half way accross my chest when i saw him

your out of luck. the law says you should have your seat belt when you get into the car. not when it is moving.

you think yours is bad. I got a seat belt ticket in alberta for not wearing a belt in the back seat. anyhow I learned my lesson.

i've seen some pics of people getting ejected from windshields from not wearing seatbelts and it isn't pretty. a two inch hole where a whole human body went thru (the windshield flexes on impact).

go to prosecutor and explain what happened
if he wont do nohting for you then go to court with ur girlfirend and explain what happened there
bring pictures of ur house and the spot sign and stuff so u can show them what happened

also explained why ur girlfriend didnt stop cuz she though u were joking and say they cop was angry cuz of that and was yellign and said mean things to ur girlgriend and made ur girlfriend cry and tell her to crty in court cuz of the ordeal.

Yeah, tell them that you didn't put your seatbelt on until you saw the cop because you figured you might have been able to get away without it for that short drive down the street.

Good one. And why wasn't the driver paying attention herself? It's not up to passengers to inform tegh driver that a cop is trying to pull them over - drivers are supposed to notice that all by themselves.

Was she failing to drive with due care and attention to her surroundings outside the car, which is where she is SUPPOSED to be paying attention?

^ i was sarcastic about the last part

but i think he could just say that his girlfriend was not looking when the cop waved her down because she was looking forward infront of her and he was way off to the side or something.

and dont say u put on ur seatbelt after u saw the cop, just say u were in the process of putting down your bag and putting on your seatbelt, the cop just happened see look when you started putting it on or something.

i doubt you will get too far in court, prosecutor will probably do more good for you though

thanks for the reply guys i just dont see a reason why i should pay 110 or so for no reason. i have been driving for over a 6 yrs now and i have a very good habit of puttin a seat belt on all the time stupid **** head cop .. the prosecutor meaning the guy who sits in the court asking what happened also my ? again so should i plead guilty with an explanation on the ticket. i swear this was a really stupid ticket.....

but behind the ticket u file it u have 15 days and it has 3 option u have to check one off pay it ... trial or plead guilty with an explanation

You want trial if your not pleading guilty.
Go to the court and tell them your story. They will def at least lower it for the sake of you showing up and missing work/school.

Sorry to bring up that 2002 thread about the seatbelt ticket, I searched seatbelt and when i went to click on next page in my search I clicked Page 17, lol and didnt even realize then posted on it...

This one is a little old but didnt want/need to start a new thread for this, just curious what happend to anyone else who got this ticket/original poster.


anyway.. I did get one of these tickets in front of my house. Its 2 Dermerit points for not wearing your seatbelt... Im going to fight it, the officer told me to anyway..

Its a myth that EVERY time the officer doesnt show up, it gets thrown out but in most cases it does.

Officer wrote down on my ticket "Passanger fail to Properly wear seatbelt"...
