HELP My liscense has been suspended

Aight folks I'm in a desperate situation.


Around May a pig hit me up for failure to present a valid driver's liscense. I had lost my wallet. He told me to get a replacement, and present it at court and I would be able to fight the 170 ticket he gave me. I got a replacement liscense the next day, but seeing as how I am a dumbass, I thought that the info re: my court date would come in the mail. It didn't. The only thing that came in the mail was a conviction notice. I was broke as hell @ that point so I had no money to pay it off. Fast forward to today, I get a letter from the Ministry informing me that my liscense has been suspended and I am hit with a $150 reinstantement fee plus the cost of the original ticket. If I drive on a suspended liscence it's a Criminal Code conviction and a 5G fine. What options do I have outside of shelling out 300+ dollars. HELP PLEASE.

super easy to do.
go to the court office.
go to the clerk and tell her that you want to reopen the case because you never got your letter in the mail for the court date.
they will send you to the jp's office.
tell them that you never got it and he will reopen the case for you and give you a new court date.

4 days later your licence will be re-instated.

simple.

did you even go to set a court date? cuz it doesn't say that you even went to set one at all in your original post?

I didn't go to set a court date. That's the "I am a dumbass" part. I've never fought a ticket before so I am totally ignorant as to how it works.

oh **** that sucks for you.
in this case you cant do what i told you before.
because you never set a court date initially.

the only option is to try to re-open the case with an appeal.
its a costly procedure to get it done and chances are you might not even get granted a re-opening. and you wont be able to do it yourself unless you have some knowledge on how things are run.

i recommend you just pay the fine and the re-instatement fee. cant do nothing else unless you know your way around the place.

right now your licence is suspended for unpaid fee's and/or fines.

once you pay it your clear to go and get the licence after 4 days (business days) and then you have to pay 150 re-instatement fee.

also a heads up would be, whenever you lost your wallet, report to the ministry for a lost license right away... they'll give you a temperory paper or something indicating you have a replacement coming in soon and you do have a license... and for that moment, either drive carefully (if you wish to give it a shot), or get a friend to drive you to the ministry right away

HOw is it a costly procedure to have your case re=opened. I missed two court dates, both for the same case. I spoke to justice of peace n both times i was granted a re-opening. theres no fees havin ur case re opened.

Where do I go to try to have my case reopened? The Ministry of Transportation or the Court?

One more thing:

Should I say that I HAD infact tried to book a court date... but never got anything in the mail...

or say that I'm an idiot...who didn't know I had to file the paperwork to challenge the ticket?

LOL that wont work.
when you apply for a court date they stamp your ticket with a stamp that has their info on it and a date with a signature. thats basically your proof saying that you filed it and unless you have that stamp you are fresh out of luck. I know a guy who has this stamp and you can fake it by having it stamped and he signs it with an appropriate date however its not cheap. oh btw you cant say you dont have the ticket anymore either cuz they wont believe you then.

read what i wrote again.
if you already applied for a court date then its no problem all you have to say is that you didnt get the court date in the mail.
if you never applied for one in the beginning its not possible and its costly to have it appealed.

or print this thread and take it to the judge to show him how hard you are trying to get your licence back...lol

I called the provincial offences office. The guy on the phone said that I can request to have my case reopened in person. I will be referred to a prosecutor to whom I can state my case. I've got a copy of the ticket, and a receipt of purchase for my replacement license (dated immediately after the ticket). If the prosecutor is sympathetic they can drop the charges and send notice to the ministry to reinstate my license. I'll be @ the court house tomorrow bright and early.

I had to pay tickets first before doing an appeal for failing to show at set court date. Isn't that the way it is?
