headlights not on at 1am
soo a buddy of mine got pulled over the other night (1am) cop came up too the car said he didnt have his headlights on (only had the fog lights on) soo he turned them on (fully operational) then the cop gave him a ticket for $110 anyway around that in court because the lights work fine 100% just forgot too flick them on honest mistake....anyone?

I really dont believe that your actual headlights have to be on at night if your other auxillary lighting is visable from whatever distance it is and you the driver can see and have enough of the road lit up...I used to just use my "driving" lights on my 1st gen crx along with the parking lights and was never once hassled...check up the HTA for more info
just turn your headlights on at night tho...pretty simple

Stupid policeman? No. Stupid you for using your fog lights as some sort of late night fashion accessory in lieu of the lighting system required by law.

In other words, you're saying that he poses with just the fog lights/no headlights only when in parking lots, unlike the posers who drive with foglights/no headlights while out on the streets because they think it makes them look cool and "special" for some reason.
Sure thing....
The ticket is still valid though. The lights you use at times when headlights are required by law must meet the various requirements laid out in the HTA, and fogs, even factory fogs and auxilliary lights, do not make the cut.
The cop who gave your buddy the ticket wasn't being stupid" as you say for doing his job - but your buddy was for not ensuring his full lighting system was on when he hit the road.
Honest mistake or deliberate one, it was still a mistake, and mistakes get you tickets.
