got pulled over...screwed...need help!!
Hey. I was coming back from Niagara falls last night; had a radar detector on...I was driving, and I overtook this car from the improper lane, and I was going quite fast. He turns out to be an undercover, and he pulls me over. Asks for my license and "radar warning device." Without any argument, I give both to him. Then he comes up with one ticket (which has options to plead guilty or go to court), and one summons form. The ticket was for the radar warning device. The summons was for doing 151 km/h on a 100 posted limit. There is no fine on that written anywhere. He just said I have to appear in court. What should I do? About the radar detector, should I plead guilty, or go to court? Also, what's the option of plead guilty with an explanation? What does that do? Since this is my first offense, do you think I can fight it on my own? I really need help. Thanks.

Dont worry you should be fine if you take BOTH them to court. The speeding ticket you can AT LEAST dropped to 149 so its 4 points and set fine NOT 6 points and maximum $5000 fine ETC.
Im not sure about the radar detecter. They dont like those...
I dont understand, 151 is not fast for me, as for most modified hondas can do 250 no prob...DAm highways.

one more thing. With the radar warning device, is it considered a moving violation? Will I get demerit points, and will it affect my insurance? Secondly, with the speeding ticket, how much should I expect my insurance to rise? thanks

how quickly did he pull you over after you passed him? because he would need to pace you for a specific distance before he could pull you over. he cant just estimate your speed as you flew past him and pull you over immediately without actually following you and pacing you.
you're probably screwed for the radar detection device though.

Over 50 is a summons to court. There will be no set fine on it and it can become a suspension of your licence.
I read on a back of a TTC once..
20 over..
30 over...
40 over....
50 over..... See you in court.

There are presently no radar detectors that are invisible to it.

I had a detector confiscated once.. luckily I was in an apartment complex parking lot (private property), so the cop couldn't issue a ticket.
regarding both charges, set a court date and pull a no-show the day of. have a friend come in your place and inform the court that you were unable to be present due to a midterm exam. you will have to post-phone the trial to a later date, and do the same thing at the next trial date. its highly unlikely the cop will show up after post-phoning 2 times.. unless he is a real hard-***.
if he does show, you can try pleading not guilty to the detector. say the detection device was non-functional (broken) and you were only using it for the digital-compass feature. your cousin who lives in vancouver gave it to you cause it doesnt work. hehe
for the speeding, be cool and they might cut you some slack with the fine, but as far as I know you can't negotiate the speed or points after the ticket has been written.

Hey. I called points and xcopper. I explained this to them...but the person at xcopper said that what if he already caught me on radar and then paced me? Is there any other way out? Otherwise, do you think I can handle this case on my own and reduce it to 4 points, or am I better off with xcopper or points? Cuz they say they can also probably reduce it to 4 points...but is it worth it? They're charging around 600 dollars.
