Got a Muffler Ticket?

This is what a good buddy of mine who has been an officer for 10 years told me. There are two basic tickets when it comes to mufflers.

1. Improper Muffler
2. Excessive noise


you can be charged for both at the same time if your exhaust/muffler is too loud. Excessive noise is obvious this is due to it being louder then stock ie. OEM.

Improper muffler tickets are another thing tho. People have this massive mis-conception that just because the tip of it is X amount in diameter that the cop is giving you a ticket. And thats due to what the cops tell the drivers when they get the ticket "your muffler is too big and its loud". Little do they know that 98 percent of the mufflers out there are illegal because they are hallow. What i mean by that is they do have the chambers inside them BUT the air does NOT get channeled through it instead it goes straight out. If you seen pics of a cut out of a stock muffler you will see that the air does not enter and exit the muffler in a straight direction. It usually looks like a maze that it has to go through and thats what basically makes the muffler legal because it muffle's the sound hence the reason its called a muffler.

so unless its your lucky day 98 percent of the time you will not win this ticket if you go in to fight it. However if you replace the muffler with a proper one and have proof this can have the ticket reduced or removed depending on the police officer and prosectutor.

good info for sure jay...but how about all those exhaust manufacturer's selling their products by stating them as 'street legal'

in most cases...street legal based on DOT standards....which by default cover all of US and correct me if i am wrong, transport canada follows the same or similar.

Or claimed as such. Several years ago, APC had to recall their Altezza-style tailights because they did not meet DOT standards.

The product packaging claimed they did, but the tailights were nowhere close to meeting them on a number of grounds - lack of side and rear-facing prismatic reflectors, use of red light bulbs which were not DOT approved, and inadequate light output.

It's real easy to "claim" to be DOT compliant, but there is no real effective testing or enforcement protocols imposed manufacturers.

is it a moving violation tho...by that i mean will it affect your insurance rates?

thanks marker.....do you know that CT and even Honda dealerships sell a manual / book of a kind that shows what is legal and illegal in ontario/canada in terms of car modifications? if someone has a copy....they should look this up. i had one that covered 99-03 but cant find it. here is a photo...

they changed the rules apparently.
i was told even if its a fault on the vehicle it will go on the record by the officer and prosecturor recently.

replacement and bill to prove it is proof enough but they might want to see the car so be sure to have brought it with you on your court date.

If your exhaust claims to be DOT approved bring the box with you and show them a pic of the exhaust on the car that should get it thrown out.

oh btw dont forget they dont have to drop the charge.
simply because its not a matter of getting the exhaust fixed and showing up the ticket was for having a non compliant exhaust system on the date of the issued ticket and since the exhaust/muffler was not in accordance with the law they can still punish you if they want.

I just got my court date in the mail today for September 20, 2007.

Any tips or things I should say?

plead guilty and get everything fixed.

thats what i am doing for my ticken on improper muffler..

replace the muffler with a stock one and take pics of it and get the invoice from the shop that shows what work was performed and on what day then take that to court and they will most likely drop it just make sure you bring your car with you just in case they want to see it. as for the tint get the tint in the front driver and passanger side lightened or removed and take pics to prove.

if you plead guilty they you will be punished for all of the offences. thats the stupidiest thing you can do.

fix everything and take it and hope for the best worse case scenario they wont drop it atleast it will stop from you getting more since your car is fixed.

couple of questions.

I got an Ractive MT602 Muffler on my car and got a ticket for improper muffler motor vehicle. by any chance can I get that dropped since they sell it at canadian tire? or do I have to go thru the whole process of changing it and showing the invoice?

another question
got a colour coating obscuring interior ticket along with the muffler. funny thing is my driver side isn't even tinted, and pass. side is slightly tinted but the back is kind of dark no too bad. any chance I can fight this one off?

please someone get back to me. thanks

Got a ticket ($110) for improper muffler last October '06. Went to the office to get my court date, will receive sometime February '07 in the mail, and still haven't receive my court date in the mail. Should I still wait the mail to come or should I call the office to let them know that I still haven't receive my court date in the mail???
